ktvu's tara moriarty joins us live from oakland with what a judge has decided. tara? >> reporter: well, you know what? emotions are still running high in this case. the parents of jahi, they sat in the front row. they were clearly emotionally exhausted but fighting still for their father. for the first time we saw -- daughter. for the first time we saw the hospital attorney break down a little bit. the two sides were trying to hash out the issue of jahi's transfer out of the hospital. the judge denied the request that a doctor from per children's hospital perform a tracheotomy. jahi's family attorney said it was not a setback today, he said the steps to ensure that the 13-year-old will be able to be transferred to another facility are more clear. he said the procedures will have to be done once jahi has left children's possibly being transferred out by ambulance. >> it may be ideal to do it at or near the facility of transfer because the fewer times that jahi has to be moved, the better. she's been without nutrition with over 24 days. that's critical. >> reporter: chi

ktvu's tara moriarty joins us from the scene to show us the extensive damage. good morning, tara. >> reporter: good morning. this looks like a deadly crash but miraculously it was not. the driver apparently allegedly drunk walked away with only a bloody nose. this car is the one he was driving. this is the silver car you can see here. it's completely mangled u underneath it, a classic 1966 mustang that the opener was keeping here for storage purposes. let me show you exactly the path of this car. we're here on grove way. this is near western boulevard just south of the 238/580 split. if we kind of come over here, this all happened around 2:30 this morning. you can see that the tow truck is here on scene. they will be taking away several cars. take a look at the damage. this is all of the glass and debris that the car hit on its way. it tore through this front yard here. took out a couple of branches from the tree, tore up this whole -- all of the glass, everything. and this bmw that's sitting in the driveway over here, this also sustained some damage. and then

tara moriarty has just arrived on the scene. tara, what's going on there? >> reporter: well, it looks like s.w.a.t. teams are just getting ready to pull out. if you take a look behind me, we're at third and kirkwood. there's the liquor store called the star market. around 6:00 this morning, we know that s.w.a.t. teams were actually sawing the metal gates off the entrance to try to get inside. we don't know exactly what they are looking for. we did speak to police but they are remaining pretty tight- lipped about everything. you can see the bus that the -- the train going by here, muni, initially the t had been shut down for some time for about an hour. we're told all trains and buses are up and running. now, again, we don't know exactly what they were looking for but it appears that there were two s.w.a.t. teams and both of them are now -- one of them has left. the other is in the process of leaving. now they are beginning to comb through the market looking for whatever it is that they are looking for. as soon as we get more information, we'll pass it along

ktvu's tara moriarty join us live from the city with a new 90-day weather forecast for california from the national weather service and i'm betting it doesn't look good. >> reporter: no, it doesn't. they are expecting the dry spell to pretty much linger for another three months. that's based on information from computer models as well as buoys out in the pacific ocean. these long-term forecasts are not as accurate as short-term ones. they tend to stick 60% of the time. the picture is looking bleak. governor brown is expected to declare a drought emergency here at 9:00 this morning in san francisco at the state building. the official drought is important, to increase awareness among residents and perhaps federal officials who could accelerate the relief efforts. the governor has shied away from the decklationration in weeks -- declaration in weeks. >> at the end of the day, if it doesn't rain, california is in for real trouble. the governor's declaration can't make it rain. we all know that. >> reporter: brown managed drought in the late '70s when he was governor before. at that time, i

ktvu's tara moriarty joins us live from where the mauling occurred. and tara, you say there is a warning for those who live in the area. >> reporter: that's right if you see a white pit bull running around, you should call 911. it is considered aggressive. it was one of two dogs involved in an attack here near this homeless encampment that you see. animal a control is patrolling the -- control is patrolling the park. in addition to the police officers. the attack happened at 25th and lincoln way. a man with two pit bulls dropped his dogs with with people at the stamp and went to go do some grocery shopping. while he was doing the dogs started to maul a man. >> we heard some screaming. my neighbors and i were looking at that. we basically just grabbed what we could. i called the police before i entered the park and saw the whole thing happen. >> reporter: police shot and killed the black pit bull but the white dog got away. the man who suffered several bites was taken to the hospital and is expected to survive. a second victim who is trying to help was

ktvu's tara moriarty says the police appear to be narrowing the search for a suspect. tara? >> reporter: well, a half-hour ago, officers wrapped under what's called a cold show in a nearby alley. that's where a witness will sit in a patrol car and a roid out suspects one by one -- parade out suspects one by one. we saw them bring out one latinawoman and two latino males and held up a red jersey to help identify. so the person responsible never left the building. there were a dozen patrol cars. police fielded off every exit. this unfolding before 3:30 this morning in an apartment building off market and okay tavgia streets. >> a 911 caller -- octavia streets. >> a 911 caller said there was a body in the lobby of the hallway and we responded and found a person stabbed to death. >> reporter: the coroner has removed the body. we're not sure how many times he was stabbed but there's obviously a lot of blood in side. the victim is from san francisco. we're not sure if he lives here but the police are trying to get ahold of his family before they release his name. tara moriarty, kt

i'm tara moriarty, ktvu channel 2 news. >>> 8:06. hearing set for today in the case of a 16-year-old boy accused of setting another teenager on fire. richard thomas has been charged with a hate crime with the attack on sasha fleishman in november on an a.c. transit bus in oakland. fleishman was wearing a skirt at the time of the attack. he suffered second and third- degree burns. thomas is charged as an adult but his lawyer is arguing the case should be moved to juvenile court. >>> the antioch man charged with kidnapping a 7-year-old girl will return to court on february 26th. 43-year-old david douglas pleaded not guilty yesterday. he's accused of following the girl and her mother from a walmart and then abducting the child earlier this month. the child was found hours later inside his car at the antioch marina. douglas remains behind bars on $7 million bail. >>> a golf pro from livermore accused of child molestation is facing new charges this morning. prosecutors say a third child has now accused andrew nizbit of sexual abuse and sh

tara moriarty is in oakland now to tell us about those settlement hearings and talks today.ood morning, tara. >> reporter: well, good morning, yes. there will be two court appearances. the first at 9:00 at alameda county spowr court. that's for a settlement conference and then they will head over to federal court at 11:00. that's where a judge will hear a request for an order requiring feeding tubes to be installed so 13-year-old jahi mcmath can be moved to another facility. jahi has been on life support at children's hospital of oakland since december 12th when doctors pronounced her brain dead. she suffered complications from a tonsillectomy. a hospital spokesperson says to date her family has been unwilling or unable to provide a physician to perform the procedures necessary, transportation or a facility that would accept a dead person on the ventilator. our hearts go out to them. family member attorney chris dolan accused of hospital of being hell bent on ending jahi's life. theirs say there's no chance -- doctors say there's no chance she will come back to life but the
