mr. gaetz. joel greenberg appears not to be in a good place which might be important context we have newly released records from the sheriff'sice in florida indicating when deputies went to greenberg's house to arrest him the deputies ended up in a five-hour stand off with him trying to arrest him. he tried to negotiate with deputies over the phone as they were outside his residence. stating at times he would take pills, utilize firearms and had a bomb and was going to use it against the sheriffs deputies. i am just going to read this. joel continued to negotiate via phone. joel made suicidal comments saying he would take pills, utilize firearms and had improvised explosive devices and had hidden several items in his anal cavity. he threw a bag of medication on to the drive way before retreating back into the residence and closed the door. it should be noted during the negotiations and a long piece of the report that is redacted. but this does not sound good. according to the sheriff's office they say he is threatening he has a bomb and he appears to have thrown a bag full of pills on to his drive way while he is negotiating

mr. brown before the deadly shooting, but they responded when they heard shots fired. so really, they were saying that the sheriff's department was involved with serving that arrest warrant due to drug-related charges and he said that if any of the deputies are found to have violated laws they will be held accountable, but alex, a lot of the details of the shooting are still unclear. they haven't made that information clear, and that's why there is so much pressure for this body camera footage to be released and important to note that in north carolina there is a law that you need to go through the courts to get those released. so it seems that there are some hurdles that need to be crossed before that footage can be made available to the public. >> okay. kathy park, thank you very much for that. we'll get right into this topic as we bring in david henderson, civil rights attorney, former prosecutor and cnbc contributor. welcome back to the broadcast, david. let's get to this particular incident. bodycam video can only be released by court order, but is there no room for a level of discretion in a case like this. >

sheriff department, which is county. none of the officers of the elizabeth city police department were involved in the process of issuing the warrant to mr. brown, nor part of the subsequent events that transpired. the city council held an emergency meeting on the day of the shooting to gather information from my city manager and our chief of police. and, also, to indicate our position on the events of that day. a second emergency meeting was held at 3:30 yesterday to discuss a formal request for the sheriff department to release the body cam worn by the county officers at the scene of the shooting. and, if denied, the request is to be forwarded to the district attorney's office, as well as to superior court. any entity, in fact, that represents the custodial law enforcement agency. we decided to hold a press conference this morning rather than earlier in the week because we felt it would be prudent to first allow space for the county officials to control the narrative, since our officers were not involved. to those who have been participating in the ongoing protests, the city would like to thank you for your peace, peaceful and orderly

on wednesday morning the sheriff's deputies showed up to serve a warrant, puck and see from the splatter on the house and the tire tracks in the yard that mr. brown was trying to get away quickly. deputies fired upon him, ultimately killing him. the car crashing into a tree there. the demands are growing louder, eric, because here in north carolina any law enforcement agencies cannot just at will release body cam video. it's pursuant to a court order, and the sheriff here, tommy wooten ii, says that he's working to get a release but hasn't done so just yet because the matter is under investigation by the north carolina state bureau of investigation. we talked to him one-on-one about it. he said he is going to ultimate i will release the -- ultimately release the footage. i asked him how the seven deputies are doing, here's what he said. >> i can tell you that i briefly have spoken with them due to the circumstances, and they're all completely devastated. they are completely devastated. they're horrified that this happened. thank you. >> reporter: and every night for the last three nights we have seen hundreds taking to the streets here fro
