supervisor avalos: mr. rose, if you want to comment on item six. >> as our report points out, although this was a competitive proposal, it was not based on cost. however, we concur with the department, because this was a professional services contract, it was based on experience and qualifications. there is also, as the engine, a contingency amount of 13.9%, about $1.6 million. that is how we get to the $13 million, plus the contingency. we also point out this is for a term of according to the agreement for up to 10 years. this specific agreement is for a term of 1095 days, approximately three years. finally, regarding the cost, when the airport submitted this in the rfp, they estimated the cost would be $9 million. it turns out, excluding contingencies, it is about $11.7 million. we asked for an explanation and we have an attachment to our report, beginning on page 6, which explains -- the bottom line is the airport underestimated the scope of this project. that is why there was an additional $2.7 million.

mr. president. i am really, really sorry, but i'm not going to be able to support this. i wanted to support this. i came in wanting to support it. i've admired supervisor avalos' work on this, i've admired the community's work. i had every intention of coming in here to support this, but then these numbers came down and, i'm sorry, but if you take the city property owners out and let's not talk about the weighted just yet, but there are 150 parcels on ocean avenue. if you take the public properties out, only 12 property owners voted yes on this. 66 property owners voted no and the rest didn't vote and i really have a tough time saying 12 property owners get to tell 150 property owners, your property tax is going up. i just -- i wanted to be there really bad because i really admire supervisor avalos' commitment to ocean avenue. it's an area that needs this support, but i just don't think these numbers are fair, and i think longer term, we need to do more. all this work, but only 12 private property owners said yes. it's not a sufficient threshold for me. president chiu: colleagues, further discussion? supervisor avalos. supervisor avalos: certainly the numbers

mr. sanders and others in the city attorney's office to look at potential next steps, and i also wanted to say that from what supervisor avalos' office has expressed to us, there have been good conversations with the industry. the voters that people put up today and last week are horrifying to me. the lack of public notice and lack of community input into the process is outrageous, and i do feel that the public was the right of way is a place that the federal government and state government have some say in, but we need stronger protections, not only raise issue of safety, but also esthetics and whether these boxes on utility poles are necessary and desirable, but it is a process that should be a community one from the local level in my opinion, but i know we have to be careful and legally defensible in what we propose, but the legislation before us is reasonable, and i do think the two-year appeals process makes a lot of sense to me. i wish it could be a shorter appeal, and i do think the industry's concerns have been listened to. on the claim of discriminatory treatment, i think that is totally ridiculous. that was made by
