mr. barrack are for him lying to investigators during that second round of questioning. the indictment until today say that he lied to investigators when he told them he was never asked to do anything on behalf of the united arab emirates. he lied when he denied that he got a special phone and especially encrypted apps to communicate with officials from the uae. the indictment says he lied when he denied putting then-president elect trump in contact with government officials from the uae. and again tom barrack has pled not guilty to all of it. the for lying to investigators, the conspiracy counts, he's pled not guilty to any of it. here is one thing i want to know about, what's the indictment of trump's inaugural chairman, tom barrack, makes clear -- and again, while, a lot of people from the trump administration have been arrested, and wow, a lot of them are ledge our confessed secret agents. that remains unsettling, right? that could happen once, it can presumably happen again, but what damage was done there. more specifically in this case though, the picture that has

mr. barrack. $250 million gets your attention. that's pretty much a quarter of a billion dollars no matter which you slice it. pulling your passport, that gets your attention. that doesn't happen to most people. having to wear a band-aid box sized gaps bracelet at minimum it's tough to accessorize with. what do you think is going on here? >> i mean, cry me a river. there are a million -- there's thousands of kids who get arrested and nobody says, oh, you're going to have to stay in santa monica and then take the first class flight to new york. you can't be bothered to be with everybody else in jail who's been charged with a crime. the guy's got millions of bucks. he only had to put up $5 million. it's just great to be white and rich in america. he doesn't have to put up $250 million, and he's cut this deal. and he has -- he's obviously a flight risk. the guy's got planes. the guy has a billion dollars. he's got houses in different places. he has friends everywhere, and frankly, i think it's kind of a sweet deal compared to what yo

mr. barrack is due back in court monday in new york.of acting as an unregistered agent of the united arab emirates, conspiracy, obstructing justice and lying to investigators. his case is just the latest in a justice department crackdown on illegal foreign influence operations. that includes cases against other members of the former president's orbit like campaign chairman paul manafort and deputy chairman rick gates. both of those men pleaded guilty to violating the foreign agents registration act. joining us now to discuss it is josh gerstein, a senior legal affairs reporter for politico. let's begin by just walking through the charges against tom barrack. these sound like very serious charges, especially if he had to bail out to the tune of $250 million. >> yeah, joshua, they definitely are serious charges. the main one here being that he acted secretly as an agent for the united arab emirates and perhaps to some extent saudi arabia. both during the 2016 presidential campaign, when he was a top adviser to then candidate donald trump,

mr. barrack made himself voluntarily available and will be pleading not guilty. from what you see so far, is it possible that could be true? this is a guy who is trying to capitalize on a relationship with the president to make money on the side and didn't cross a line or do you think from what you read that it really does look damming? >> i think it looks really damming, erin. now, he will plead not guilty initially and try to navigate this the best way he can. what you're talking about is multiple, multiple instances where barrack very clearly was taking dirrection from foreign government officials using it to influence other u.s. government officials. that fits perfectly within the parameters of the foreign agent registration act, which requires it if you're going to do that and act on behalf of a foreign government in this country, you have to first register with the attorney general and he clearly didn't do that. he's looking at a tough case. >> so let me ask you, when we try to get to the bottom of this it could be this or part of something even different o

mr. barrack has made himself voluntarily available to investigators from the outset. he is not guilty and will be pleading not guilty. barrack is also one of seven former trump campaign associates to be indicted. if the charge of failing to register as a foreign agent sounds familiar, paul manafort, the former trump campaign chairman, was convicted on that very charge before trump pardoned him and his deputy, rick gates. prosecutors have asked that barrack be detained until a bail hearing can be set. the fact that he is a citizen of lebanon, which has no extradition treaty with the united states and because of his ties to the uae and saudi arabia. joining me now is chuck rosenberg, former u.s. attorney and fbi official. i guess the obvious question here for tom barrack, who seems like a smart guy, well read individual, is -- and it kind of goes for paul manafort too. wouldn't it be easier to just register as a foreign agent? >> oh, absolutely, joy. look, this is not that complicated. everything they did, they likely could have done if they had just followed the rules.

mr. barrack well before 2021 but were discouraged from doing so. as members of congress, we request that you conduct an investigation into whether barrack or any other friends of the former president were given special treatment by the u.s. justice department during the last administration and whether barrack's case was inappropriately suppressed. i mean it is one thing to have this actually quite scandalous reporting about the barrack case, right? there's serious national security implications of foreign agent prosecution being delayed for more than a year. this is a serious case about another country having high-placed agents inside and adjacent to the u.s. government in a way that is affecting u.s. policy in a sure repetitious way, right? it is a serious national security matter to delay the prosecution and allow that scheme to continue for a year while you try not to offend anybody by bringing the case, by bringing the case, like that's a serious thing. but these members of congress i think are right to look beyond just this one case. i mean the

mr. barrack made himself available from the onset and he's not guilty and will be pleading not guilty. >>bill barr broke the prosecutor's code and corrupted the justice department ". let me ask you. there is a lot of questions here about this. days ago, prosecutors said tom barrack was a flight risk. they did agree to release him on bail but the security here is stunningly high, right, a quarter of his estimate the net worth, a quarter of a billion dollars an incredible amount of money. from your experience when you look at that and how this is going, does this mean prosecutors think barrack may cooperate? >> so, erin, this could be win or b -- one or both of two things. they could be satisfied he opened up enough cash and sureties and the gps monitor he has to wear. the prosecutors were first against that and said he's an enormous flight risk with too much money and connections around the world. it could be that changed. the other possibility is it could be they've agreed to let him out as part of some agreement that he will come in and try to cooperate. that is rare but i can tell you f

mr. barrack invited senior emerati officials to give them a wish list of foreign policy moves they wantede end of mr. trump's term. talk us through what would happen in a normal environment where there was not a nexus of criminality. if someone came with a wish list, what would ordinarily be the response? >> well, i think, first of all, the normal thing would be to pursue that kind of wish list through established channels. that's why there are ambassadors who meet with sitting u.s. public officials and advocate for their country's interests and try to persuade the government, the u.s. government, that it's in our best interests to work with them. i think what's so, i think, dangerous about this is clearly they were not going through official channels. you have someone like barrack who based on the reports was making an enormous amount of money for his advocacy for the emirates, kind of back channeling in this wish list that presumably was also coming through other channels. if you think that you can make the argument that it's in america's interests to back the broad and comprehensive em

mr. barrack gain from all of this?he indictment. prosecutors are not required here to prove some sort of monetary benefit. so i think it is a big unanswered question. what did tom barrack get as a result of this? we don't have it from the charging documents and we don't have it from the allegations so far. so i think that's interesting, what type of benefit he may have received. but i think when we step back and look at this, we have somebody who according to the allegations today, and as you said tom barrack intends to plead not guilty to them, somebody who is actively pushing united arab emirate causes with this white house, with the trump administration, while, as you said, at the same time providing key nonpublic information back to the uae. also, saudi arabia is mentioned in the detention and removal order today for tom barrack and his relationship with them. so did they get some sort of a side benefit as well? some of that nonpublic information was the thinking, according to federal prosecutors, of other high-lev
