mr. boozman. mr. braun. >> just to explain to our viewers, what we saw, the point of order that was introduced by rand paul essentially was tabled by a count of 55 voting yea, 45 voting nay. essentially the argument he was making that the former president cannot be impeached or his trial will not be held in the senate. that has failed. let's bring into the conversation with us daniel goldman. let me get your reaction to the point of order that was introduced by rand paul failing. what do you make of it? >> well, the most interesting thing is that it was 55-45, which gives an indication of where the senators are on the vote to convict. if 45 senators are favoring dismissing the trial because it is unconstitutional, then it is hard to see a path to 67 votes for conviction. so that is quite news worthy. it is the first test to see where people are as it relates to this trial. as a point of historical perspective, when the secretary of war in 1876 was tried after he was removed from office, after he was o
