mr. brennan himself. he wrote an op-ed. he was not a nominee for judge then saying johnson's right to hold the seat open should be respected. now he's here on the floor with the blue slip being ignored for the first time since i've been here. that's since 1998. how is senator baldwin's right to consult on judges for her state any less important than senator johnson's? it's mind-bending hypocrisy. it's an appalling double standard. and it's another erosion of minority rights and the tradition of comity that i know so many of my colleagues on both sides of the aisle wish played a greater role here in the senate. furthermore, there's been a -- senator baldwin has talked about -- there's always been a bipartisan commission recommending judges in wisconsin. and there were several nominees who got through that bipartisan commission. you need both democratic and republican support to get through that commission, as i understand it. they were ignored by the white house and here senator -- judge brennan or mr. brennan, a hard right

mr. brennan's nomination. this comes as only the latest distinction in a career marked by truly impressive legal accomplishments. in both public service and private practice, this graduate of notre dame and northwestern law school has developed a represent fiergs a keen legal mind and unwavering commitment to the rule of law. according to current and former peers on the milwaukee county circuit court, mr. brennan has, quote, the mind, heart, and soul of a great jurist and a keen understanding of the legal issues and sophisticated and complex litigation. like judge engelhardt mr. brennan has my full support and i encourage my colleagues to vote to confirm another fine nominee this week. now, on another -- on a final matter, it seems that every day it brings another piece of good news for middle-class workers and families, and like clock work, another desperate attempt by my democratic colleagues to convince everyone that this growing tide of new prosperity is somehow a bad thing. in the last few weeks alone the

mr. brennan's fitness to serve on the federal bench. i'll just mention a few. mr. brennan has mocked millions of hardworking women who have faced sexism and obstacles to advancement. he has dismissed the idea of a glass ceiling. mr. brennan has defended a wisconsin law that added unnecessary barriers to women who were seeking access to abortion, even in the case of rape or incest. mr. brennan supports criminal sentencing policies that slap low-level offenders with long jail sentences and exacerbate the problem of mass incarceration in america. and it gets worse. mr. brennan believes that it's a-okay for judges to refuse to follow binding court precedent when the judge just thinks it's incorrect. now, that is extreme. but senate republicans have shown, they just don't care. they are willing to do whatever it takes to hand our courts over to moneyed interest. and there are many other radical nominees who are also in line. i want to take some time to talk about one of them, but i think it's important to explain just what's at stake here. in 2015, i was honored to join

mr. schumer: well, madam president, later today, the senate will vote on the confirmation of michael brennan to the seventh circuit. over the objection of one of his home state senators, senator baldwin, who has not returned a blue slip on his nomination. it's an abject breach of senatorial courtesy that both parties have long respected. in fact, the seat mr. brennan will fill on the seventh circuit has been held open for six years by the senior senator from wisconsin, senator johnson, via the same process, the blue slip. when barack obama was president, when patrick leahy was chairman of the judiciary committee, we democrats obeyed the blue slip, and it led that seat to be vacant for six years. now that the shoe's on the other foot, the republican majority will ignore the blue slip rights of a democratic senator, even though they fervently believe that we ought to listen to the rights of the republican senator of wisconsin, and this -- their actions, the republican leader, arose one of the few remaining customs in the senate that forces consultation and consensus on judicial nominations. in

mr. brennan: very unfortunately i think mr. trump has been fueling polarization and partisanship in this country. and that is very much, i think, undermining what this country really is all about and what it needs to do in the future to confront these challenges oversees, as well as domestically. and we really do need to have the people who are in either elected positions or others, appointed positions, be able to speak openly, honestly and candidly. both to him, as well as to the american people. and stop apologizing, or making excuses, for really bad behavior. for unethical behavior. for things that lisa mentioned before, just breaking norms left and right. what signal is that sending to the young children of this country? what signal is it sending to the world? we need people like john mccain and jeff flake and others who have had the i think intestinal fortitude to speak out. but too many of those, i think, and speaking of myself, i'm not a republican or development i have friends and enemies on both sides of the aisle. and
