mr. burton: i certainly agree with him. i would just like to inform him that right now the foreign affairs committee is holding hearings on the number of pieces of legislation that will deal with and refine the war powers act and hopefully correct some of the loopholes in it so that congress is included in the loop. so i'd just like to inform him of that because although i would like to see this in this particular legislation that we are talking about and discuss this in some detail, i think the hearings going on right now will go into in depth the problems that we face with that bill. the one thing i would say is that i think we all agree, democrats and republicans alike, that this body and the other body ought to be involved in the decisionmaking process before we go into any conflict. and this issue of libya is a perfect example of where the executive branch has run away from the congress without consulting with us. and that's something that should never happen in the future, especially when we are risking american lives

mr. burton's method. it's an outdated process but the outdated tax subsidy still remains on the books, amazingly enough. with oil hovering at a hundred dollars a barrel and big oil reaping record profits, it defies logic for the government to spend billions of taxpayer dollars on these subsidies. we are writing out a check, $4 billion, to the big oil companies. does that make sense, when we have so many other needs and we have a huge deficit? to me it doesn't. at the same time americans get hit with a double whammy. when they drive up to the pump, they're paying $4, close to it, a gallon for gasoline, diesel fuel, and big oil is taking some dollars out of their pockets because their taxes, a small percentage of it, goes to pay these big oil subsidies. how galling. in my home state of new york, the price of gasoline is up 35% on average compared to this time last year. economists estimate that a typical new york family, a typical american family will pay as much as a thousand dollars more on gas this year

mr. burton: i thank the gentleman for yielding. i don't know there is a great deal to add what he said about permits and the issue that's been discussed just recently. the thing that really bothers me is just a few years ago, 25 years ago we were importing about 28% of our oil. today, we're importing 62% of our oil. more than double what we were doing just a few years ago. and the american people are paying the price instead of $1.50 or $2 a gallon, they're spending $4 a gallon for gasoline. in the gulf of mexico there's an estimated $86 billion barrels -- nationwide there's 86 billion barrels of oil, 51% of that is in the guffleguffle which means there's -- in the gulf of mexico which means there's 240 trillion cubic feet of natural gas. for us to continue to be dependent on foreign energy sources is crazy. we ought to start drilling and doing what needs to be done here in america and we can do it in an environmentally safe way. we can do it in alaska offshore and we can do it in a number of places. to continue to send our money t

mr. burton's method. it's an outdated process, decidedly, but the outdated tax subsidy still remains on the books, amazingly enough. with oil hovering at $100 a barrel, big oil reaping record profits, it defies logic for this government to spend billions of dollars, for these taxpayers to give dollars out of their pocket every year when they're struggling to tax giveaways to big oil which is making record profits. believe me, the free market gives the oil companies enough of an incentive to produce. when oil is $100 a barrel, they don't need an extra subsidy from the federal government to produce. they're going to produce every bit of oil they can. they make huge profits. so they don't need a financial nudge from washington. and at the same time, middle-class americans get hit with a double whammy. they're paying $70 or more to fill up their gas tank and then their -- some of their hard-earned tax dollars are being used to line big oil's pockets. in my home state of new york, the price of gas is up 35% on
