butler. the project sponsor is mr. spears and mr. quinn, they say they got their inspections, they got their permit, the work was done, it was finished and signed off. if the permit was for final inspection only and all work was complete, that is the fiction. that all the work was done. i think that it does not take too much to understand that rather than the first time around when it took six months to go through the planning process, these delmon could not wait. they found another way. if you misrepresent the application that issues a permit, that is on its face a fiction. to say that a permit for final inspection, all work is complete, is then constructed from scratch, they have admitted it here. your process involves a long and patient record of proposed construction. when this happened, the face that everyone who follows the rules has in the process is harmed. -- faith that everyone who follows the rules has in the process is harmed. we would like the -- this would have happened if there were allowed to review the permit applica

mr. butler, did you actually hear the hearing that took place? >> i was at the hearing. commissioner mccarthy: did you hear the comments of the zoning administrator? determining that the -- that no notice was needed? >> i did hear that statement. our complaints with planning were fourfold, one of which was that a new environmental review process would have had to occur if they had checked these plans in february 2011. we went to the landmark preservation advisory board's predecessor board, and senior staff said it would not be allowed under the current environmental review procedures that are in place at the department. a decade ago, the city did not apply -- the planning department did not apply the same review procedure as they do today. while mr. sanchez has the ability to issue a zoning administrator is determination erie we have a memo discussing having met with the zoning administrator, but he did not issue a determination. there was no appeal will document. we are here because there is no place else for us to be. >> i just wanted one question, and thank you. you k

mr. butler. this deal concerns a new contract for a final inspection on a project. when in fact no work had ever begun on the original permit expired for nine years. the new permit was issued without complying with the mandatory conditions imposed by the building code. we're here to oppose the failure to issue a determination on the back of code violations presented to her, and to request of building inspection commission to reimburse the statement of the permit. the errors made by the executive and regular staff members in issuing the permit were brought to the attention through complaints made in july and august. there was no resolution of these complaints by the staffwith no r was again accosted on february 3 for her determination of the effects of the alleged code violations. she did not reply. to her credit, she did provoke a credit as having issued an error. this is very important, because inspection records show no work was performed on the prior record. no work begun means it was not tested. this would have allowed the project to be entitled coming in to be
