mr. campbell? supervisor campos: mr. campbell? >> yes, with the s.f. p.u.c., miss miller is quite right, there's a $500,000 not to exceed contract the p.u.c. has with power, with $390,000 remaining on it. as miss miller notes, every dollar that we can husband will be available for outreach and marketing and potential appropriations that might be needed. so there is a very strong interest in keeping consultant costs down to what actually lines up with what we need. on that point, one of the bits of direction we also heard an item similar to this, an item that was related to the extension of the contract, it's now been extended for another 12 months that was approved by my commission last week, last tuesday. it had a clear direction to only be hiring consultants for projects that directly relate to the scope of the program that we are envisioning. there are parts of the proposed scope better currently in discussion with local power and the advocates that do not line up with the existing plan for the program. supervisor campos: supervisor mirkarimi? super

supervisor campos: thank you, mr. palsen. next speaker, please. >> good afternoon. my name is charlotte noss. i'm a staff attorney at the legal aid society employment law center. i'm here to speak in favor of supervisor campos's amendment. this is the largest legal organization in the western united states. we're dedicated to protecting rights of low wage and immigrant workers. we hold five weekly worker rights clinics, provide legal advice and referrals to over 2,3500 workers a year. in addition we have several telephone hot lines. for example, work and family hotline already so far in 2011 we have received over 1,000 calls. we see widespread abuse in low wage and immigrant-dominated industries, like rampant wage theft in industries we serve, the current loophole allows employers to steal employee benefits. we have heard stories from workers who are impacted by the loophole. workers who don't know they have these benefits and incentive for employees to hide these benefits from the employees. we heard from workers prevented from using accounts and can't get the most

supervisor campos: thank you, mr. president. i want to thank everyone who has commented on this. i, as a general rule, i am open to continuance. a continuance is appropriate only if there is actually room where two different views of the world can coalesce. the problem that we have here, and we have heard from supervisor wiener, and i have a lot of respect for supervisor wiener about the contrasting this plan with a sledgehammer. the courts made it clear, but to the extent that you try to define the concepts of benefits and try to micromanage this kind of an account, that you are going to have legal problems. and to the extent that people are talking about compromise, the compromise that has been discussed, and we heard that in "the chronicle," focus is on the kind of benefits that would be required for employers to give their employees. it would put limitations on the limitations employers can place on the accounts. if we go down that road -- and i think that is what my colleagues are thinking about when they talk about compromise -- we are falling into a legal trap that will en

mr. bryant clemmons, who was the juror who chaired that subcommittee for us. thank you. supervisor campos: thank you. and thank you for your service, and welcome to the meeting. >> thank you, supervisors. when i started on the grand jury, and never thought that i would be investigating the ethics commission. initially, it was not even anything we were thinking about investigating. we were looking at something else, and that investigation brought us into the ethics commission for part of that other report. some of the things that we saw other kind of surprised us. because the ethics commission is supposed to be the organization that is watching out for the citizens and making sure that the rest of the government is functioning in the way we expected to. we found a number of things, and like we said in our report, we're not trying to be a complete review the ethics commission. this is just a small part of the ethics commission. it was not the main focus. but we found a few things that seemed, looking at it with a fresh set of eyes, as you said, just did not make sense to us. so we thought w

campos: thank you. net speaker. -- next speaker. >> my name is douglas yelp. if mr. joe lynn was here the ethics commission would be far different and actually accomplish something they would be proud of. if they do not have the money to televise, where does he get the money on the tony hall case? in my opinion that case could have been resolved in roughly 30 minutes of face-to-face negotiation. secondly, mr. lynn mentioned to me that the ethics commission has the ability to refuse to put its findings in writing using different loopholes as he told me over the phone, even joe live in that cannot stop him. of course i had nothing to do after he told me that. what i feel the ethics commission should be doing is to protect the citizens. in the case that i had mentioned earlier, there were two witnesses committed. i asked the enforcement officer at the ethics commission for a simple yes or no answer. number one, did you talk with the first witness? no answer. no. two, did you talk with the second witness, mr. phil ginsberg? no answer. to this day i still do not have a wr

mr. chairman. jose moscovich. my report is on your desk. highlights a few things. thanks to commissioners campos and weener for attending and providing clear direction on a meeting that we held last week on the region transportation plans, a communications strategy, which we organized in order to continue to get public input and provide a forum for discussion. a very important topic, which is the discussion, and in different ways in which the region is likely to grow from now until 2040. in particular, the way that over three-quarters of a million housing communities, over a million jobs will be absorbed in the region over the period, of which, depending on the scenario, san francisco will be handing over 100,000 housing units. he turned rememberthe discussioy productive, one that shed light on a number of issues. we continue to emphasize the point the community is willing to accept growth need to also be rewarded at the regional level, the commensurate infrastructure. so there is credibility for selling the additional population, and jobs. we have also stressed the point that communities that a

mr. chairman, however, we do it -- include the mta in all of the reports. supervisor campos: which is the third item on the agenda, urging the mta to take appropriate steps, and we will get to that shortly. colleagues, any comments or questions? with respect to the issue of capital projects, my understanding is that the amount of money in overtime that is expended on capital projects is about 7% or 4%, 6%, depending on the fiscal year. >> correct. supervisor campos: i do not have a problem with that approach in terms of going forward and excluding capital projects, to the extent that we are talking about a smaller percentage of the amount of overtime. but i do think it is important for us to deal with the issue of overtime when it comes to capital projects. maybe there is a different process that we should put in place, or at least a separate discussion. >> we can begin to report on the actual overtime within those continuing funds. often it is more efficient and cost-effective for departments to use overtime, rather than hire additional staff to complete a capital project t
