there's an interesting thing in mr. chris' testimony. he wants to introduce a voluntarinesss in process in the military process and if i were providing legal advice for that, i would advise mirandaized statements people i would send to the military commission. it's the same inquiry. miranda came out of the voluntarinesss in standard. the court stated to it was too difficult to manage and wanted a prophylactic rule. that's probably where we would be headed, you know, in the military commissions process if there was a voluntariness standard. we would look to the knowledge of the detainee to his right to an attorney and, you know, stop talking and various things like that. a second point that i would make -- and i think this is -- i think this is an important one. if you're moving to a system where you don't want to have the detention of enemy combatants to the end of hostilities, which is kind of the old system, right, but instead you want to use federal criminal trials and military commission trials for the vast majority of these cases fo

mr. chris let me ask you, representing the department of justice. in your judgment, do you believe that this bill as drafted, that these provisions conform to the hamden standards? >> yes. to the extent that the uniformity principle from hamden applies, i think it is met here. jay mentioned some of the differences and i think his justify cakeses make sense. we have some recommendations for change but those aren't rooted in the uniformity principle at all. >> i'm asking you questions. it's been argued that it's not appropriate for the department of defense to prosecute terrorists. do you believe that it is appropriate for the department of defense to prosecute alleged terrorists with these military commission instead of the department of justice doing all the prosecuting in article 3 courts? >> yes. i think the president made clear in his may 21 speech that we will prosecute in federal court and where there is a law of war violation and under a reformed system of military commissions we will als

. >> i would agree with what mr. chris said with respect that it doesn't prosecute.in the immediate years forward, we think the sun set provision is a good idea. let me turn to a follow up question on comments the chairman made in the opening statement regarding resources on the defense side in the efforts we are discussing today. the chief defense counsel reaches a memo that i thought reaches some issues. whether the committee bill addresses the needs to the defense appropriately. may we move back across. i don't see anything to our point about is it in the current bill. i do think that the defense council need more resources. senator the legislation itself in selecting the defense council. in terms of resources at presen@ one of the things i'm focussed on and concerned about is whether or not it is in this legislation is something i intend to push on making sure our defense counsel is adequately trained in capitol cases. their aba standards for capitol cases. we owe is it to the system to make sure our defense council are adequately trained to handle capitol cases.
