mr. garcia, hit my name is arthur bryden. we service a consulting firm in five states. we are not legal counsel. i think in this case, this gentleman owns the franchise. he has done everything that -- and gone beyond that at the entertainment commission and the supervisor mar recommended they do. he is trying to be a good neighbor. they have not even opened yet. they spent the last month going around the neighborhood trying to build bridges and cooperate with a fellow -- the fellow residents. i believe it would be unfair, they have done every single thing. everything conditioned on the permit. they have gone beyond that. yet they still have not opened because they continue to want to build bridges with the the neighborhood. i think it would be unfair for them to be closed before they get started. we went to two hearings with the entertainment commission. very exhaustive. the gentleman from the police department supported the permit. now you are being asked to revoke it before they get out the starting gate. that does not seem fair and it seems a denial of due process. t

mr. garcia to see if they can help provide whether that would be through a waiver program or through a transitional kindergarten location. i'm staggered that they feel it is acceptable to throw effectively 300 applications oits of the kindergarten process without giving the family any other option. likewise from an -- a perspective, everything i heard coming out of sacramento, is that one way or the other, a.v.a. would be available for those children and i don't understand why the district is happy to walk away from that money or from those children. thank you. mr. soriano, you have three minutes of rebuttal. >> thank you. i think that president garcia has hit the nail on the head with his questioning. there is no complaint about any aspect of this permitted work. they are looking for a way to dumb up this project. there have been a lot of misrepresentations on this. the revised plans do not show any water heater or furnace on the roof and there will not be anything on the roof. to clarify this whole thing, perhaps the easiest solution from the board, what we would ask for is to modify the original permit to remove the roof deck. that way, we do not have to proceed with the revised en route deck, the notice issues or hearing issues on that. everybody knows what the scope of work is. these new items were not in the brief period that are less second items brought up to try to address the concern that there are no legitimate complaints being made here. mr. duffy said the revised permit was the same as the original permit without the roof deck. that is what we said we are going to do and that is what we are representing to you now. perh
