mr. harper under your framework for the fourth amendment does it protect an individual's ability to control personal identifying information and to be anonymous? >> it depends on the circumstances. if you have taken steps to protect personal identifying information, absolutely yes. most of most of us share a lot of personally identifying information all the time. by entering the room we share the appearance of our face. by posting on a public forum we share identifiers. when we interact with websites we share the ip address which is essentially an identifier which can be quite reliable. so it depends on the particular factual circumstances and whether or not the person tried to restrain access to the information. there is a really interesting dimension to the license plate tracking that we now know is going on so comprehensively. and that's the license plate. i am pleasantly surprised by the emergence of this issue because i wrote something like 14 years ago and testified in congress about the privacy invasive aspects of requiring drivers, requiring license plates on cars. nobody at the tim
