howard: no, sir. mr. rice: ok. so you would deny that there has been any type of retaliation, audits, that type of thing from the irs because of people so-called scrutinizing. ms. howard: the way foia requests come in logged into a system and the folks that work the foia requests have access to the system and rest of the irs has no need for access -- mr. rice: that's not my question. my question is has the iirs participated? ms. howard: i have no direct knowledge of audit side of the house. that's not my area of expertise. mr. rice: but you have knowledge of foia side of things. and you're denying there would be any such retaliation. ms. howard: i have not shared any information with anybody that would be in a position to retaliate. mr. rice: ok. let me go further to a comment you said made a little bit earlier with the chairman regarding lois lerner, are you saying and i just want to clarify your testimony here today, are you saying there was no special treatment that was given to her for protection in spite of fac

howard: i think this is very -- mr. jordan: was it requests from outside folks, people we heard from yesterday, groups that were targeted was it to deal with that as well? ms. howard: it was. most of the documents would be responsive to congress, investigators and the foias and so we centralized the process for gathering them and redacting them. mr. jordan: and was that unusual for the i.r.s. to create such an entity? ms. howard: i think it was a normal response to an unusual situation. i see the i.r.s. do this. when we have surges of work or -- mr. jordan: so it's not unusual for them to put together a special team? ms. howard: it's not unusual for us to gather together resources that are going to be focused on -- mr. jordan: are they called special teams? ms. howard: and if i gave you the impression there was a title called special team, that's probably not correct. mr. jordan: i'm just using what you said, special project team. ms. howard: it was a project team put together. mr. jordan: ok. and who was on that team? m

mr. pitts: dr. howard, i can imagine that it is a logistical challenge to provide care for the responders and survivors who are scattered all across the country. what can you do to ensure that a physician in another part of the country, seeing only a few world trade center patients benefits from the clinical experience over the physicians in the new york metropolitan region, who have more experience treating these w.t.c.-related health conditions? dr. howard: the nationwide provider network that we have, which is currently seeing about 8,287 individuals, we have total coordination with that provider network. on the one hand, all of those individuals who do monitoring for our survivors and responders that are in the nationwide program are trained, occupationally trained physicians, so that they are equivalent to the physicians that we have in our senters of excellence in new york and -- centers of excellence in new york and new jersey. we also provide them with additional training. we're working with medsca

howard just following up on a couple of the questions that mrs. ellmers asked about the conditions, for the record what is the process by which you can add new conditions to the program? dr. howard: well, first of all, the administrator has the ability to add a condition on his or her own motion. the other very common route that we have seen so far is the public can petition the administrator to add a condition. as i said, we received seven petitions so far. two of those we added the condition, the first one being cancer the second one being a particular type of cancer, prostate cancer. the other five we have found insufficient evidence for. ms. clarke: i understand the statute outlines specific timing requirements to respond to those petitions. could you describe that for us? dr. howard: the administrator has 60 days to respond to a petition unless the administrator refers the petition to our scientific and technical advisory committee and then the time frame is 180 days system of for instance in terms of the first petition on cancer we referred t

mr. chairman. dr. howard'm a former deputy mayor of indianapolis in the late 1990s, and we hosted the police and fire games in the summer of 2001 before the 9/11 attack, and there were many two parrished in the attack, firefighters who parrished and participated in the games, but we also have a group called task force one that traveled from have indiana 5 to the world trade center, and i since learned because of the hearing, that we have 53 people in the state who responded. i have 12 in my particular district, and i want to pay particular tribute as other colleagues have done not only to all of those from new york and new jersey but people like individuals from task force one whose engineers and technical experts and their search dog traveled immediately that day ral ye and continued to operate around lis the clock with all of their man an brothers and sisters in new e, cha york.rl there was a story several years a ago about an indianapolis fireman and member of task force one, charlie, who was deployed, and

mr. chairman. dr. howardhe world trade center health program lives on centers of excellence provide most of the mark and medical care to the program come and those centers conflict commissions that about specialist knowledge base indeed express in treating the unique physical and mental health needs of 9/11 responders. i know you talked about this. i'm following up on what mr. guthrie said. i know patients in the new york city metropolitan region continue to see their personal physicians for their general health care needs but often up in monitoring and treatment services for the conditions at the centers. i also understand that somebody's in another part of the country they can go to a network of doctors that are provided through the program. some of them also come to the centers for i know at the new jersey centers we get people from all of the country that will travel just because of the expertise that exist. if you could comment on the treatment benefits of individuals using the centers rather than their

mr. burgess: it would give a better control if you age match for people in similar occupations. dr. howard: yes, sir. mr. burgess: switching gears a little bit you mentioned you're trying to aid not just individual members but help grow the body of evidence and the body of information. so that you can help in other situations. are you going to be able to provide feed fwook -- feedback to municipalities and boroughs as to the type of workers compensation coverage that may be provided to members of the fire fighting community or the type of health insurance that's provided? some of the shortcomings you mentioned were within the workers compensation system. are there lessons you have learned that can be extrapolated to other communities? dr. howard: certainly. i think new york state itself, its legislator and governor have responded to this issue by providing a mechanism by which responders, survivors, can sign up to a program, they don't have to actually make a claim but they can register and then if they should develop a condition later on that their claim would not be beyond the statute of

mr. howard sch wrfplt it. is the u.s. chasing the shadow and clutching the wind or did china do this? >> well nobody knows, but it's a good opportunity to be able to prove once again that it is the chinese, and the data that was taken was normally important to an intelligence agency and the methodology was similar to what they see out there and there's a good likelihood and once again there are ways to cover their tracks to make it looks like somebody else. this is difficult and troubling given the data of the personnel management retains on all their employees. >> and tom, this is what i don't get about this if somebody broke into a federal building and stole the paper files and it got traced back to a government it would be like a war would be about to start, and when it's a hacking, 4 million people yeah we think we know who is it and why the nonshaw hraupbs? >> well individual hackers and individual hacker clubs wanting to show they can get into the systems and penetrate the security but in the case of foreign governments they are specifically looking for information that is going

howard: not today, no. mr. cummings: when? ms. howard: i'm eligible, but what keeps the work is the dedication of my employees and the professionalism of my colleague this. mr. cummings: what can begin to improve this system, and then i will be finished, mr. chairman. ms. howard: we would like advanced technology to make it easier to do searches. we would like at irs access to a really good foia system that help us be consistent and accurate with reductions so we could get more done with the same amount of people. it is think that my folks do in disclosure other than foia's is they are responsible for doing 6180 reductions and also for making sure that the employees across irs know of the disclosure laws and have questions about disclosure answered as they need on a day-to-day basis. we have those responsibilities. i think the technology would go a long way. additional staff. what we see is a trend in the complexity of requests, so instead of requests the mostly for taxpayers asking for their files, we're seeing more of the types o
