joyce vance. no one was expecting mr. mcmichael to take the stand. >> this is a somewhat surprising decision to put him on the stand. katy, this is not an effort to win an acquittal. this is an effort to hang the jury. they're trying to appeal to one or two jurors to convince them that they should not convict because of this reasonable notion of law enforcement training and arrest under georgia's then in place, now removed from the books, statute that permitted citizens' arrests. this is i think something that could backfire. i expect the cross-examination of mr. mcmichael will be brutal. if it were me, i would dig up every training officer he had ever had at the coast guard and have them talk about whether the picture he puts on the witness stand of someone who is fully trained is consistent with how he behaved when he was on active duty. i suspect that they may even open the door to bringing in some of the racist statements that mcmichael made on the day that he killed mr. arbery. this is a very perplexing strategy. >>

joyce vance. where are we right now in the cross-examination, how much longer do we expect mr.. mcmichael is off the stand but he's subject to recall, so he could be back on the stand at some point in the trial. we're simply not sure yet. the defense says they have several more witnesses to call, but of course this morning, that cross-examination was really probably the most explosive part of the trial thus far. just hearing prosecutors sort of back him into a corner, trying to get him to answer questions directly, yes or no, was he a threat, did he have a weapon. did he try to get away from you, did he speak to you. all the answers to those questions were no. it took a long time to get to them. there were multiple encounters in the few minutes between mr. arbery, and mr. mcmichael where he was asking arbery questions, and arbery was not speaking, was trying to get away, and made no obvious indication that he had any type of weapon or was a threat. prosecutors drilling down on the fact that he had an opportunity to walk away at several points or even just trail behind arbery by

mr. rittenhouse was acquitted. >> let us bring in university of alabama law professor and former u.s. attorney joyce vance. joyce, you and i have been talking about this case now for a few days. i want to get your sense of what could have gone on behind the scenes. what could have gone on that we did not see? i know there were cameras in the courtroom, but there were moments that were not televised. what could have happened that might have influenced this case? >> well, the devil is always in the detail in these cases. particularly with jury verdicts where trials happen under a microscope, it's awfully easy for us to dissect them afterwards. the people who know everything that happened are the people in the courtroom, the jury. and even with access through television, the jury saw every moment of evidence. they saw the looks on witness's faces. they tested their credibility. they had access to all of the evidence in ways that we frankly don't have as members of the public. so one of the things we need to remind ourselves, when a verdict like this happens, that many people are dissatisfied with, is that it

mr. arbery was trapped like a rat. that's what he told the police. trapped like a rat. >> joining me now is joycebama school of law. what is your reaction, joyce, to the self-defense strategy? >> well, it's an interesting strategy. it's probably the only strategy available to these defendants on these facts, and this is, alex, why cases go to trial, when cases aren't close, usually they result in guilty pleas on the terms that are the most potentially favorable to defendants. but here, the stories told by both sides are in sharp contrast. the prosecution has a lot of its evidence on video, and they're already, in opening statement, beginning to play that evidence for the jury, ultimately the jury will have to resolve these two very different versions of what happened that day. >> yeah, for sure. what about the growing controversy around the jury in this case made up of 11 white jurors, 1 black juror. take a listen to what the presiding judge had to say about the discrepancy. >> this court has found that there appears to be intentional discrimination in the panel. quite a few african-american juro

joyce vance, the huber statement brings up something uncomfortable. two people died, one almost died. and nobody's paying any penalty. now, some could argue that the trial itself was a form of penalty for mr. rittenhouse, what was facing him. but how does the huber family get closure? i don't know if they ever will. >> you know, it's a really difficult issue. and i'll speak to it personally, because my father-in-law who was a federal judge was murdered because of his judicial service. and ultimately the man who was responsible for killing him was convicted at trial in both state and federal settings. and that fact of conviction does give families an enormous amount of closure. and something i've always been acutely aware of as a prosecutor is that there are a number of things that are important to victims. but among them is learning the truth and having people accept responsibility and be held accountable. and so in this setting, where yes, to some extent the family does know the truth, and they've been able in some cases to see video, as grainy as it is, yet the notion that kyle rittenhouse, who for instance when he was released pretrial, hung out with members of the proud boys and flash

think that joyce is absolutely right about the importance and possibility of conviction for lesser included offenses. remember actually the most serious charge in this case is the murder charge for mr get 25 years for reckless endangerment if he's convicted of it. i do think it's important. i was a little concerned that the judge in this case, and i think we should mention that this jury could become a hung jury. if it does, i think in part it's going to be because the judge communicated in my view let's say some bias, okay, in this case? he communicated it in different ways. we had the issue most recently of veterans day where he asked about veterans in the room and the only veteran in the room was a defense witness, a defense witness and then he called for the room to clap for the veteran. now if he had said any veterans in this room, let's all applaud for any veterans who served but not singling out, and there were other aspects of his behavior that i think, and there is research behind that that judges do communicate sometimes nonverbally in ways that jurors get. they're using the judge as the neutral arbiter sometimes tounder stand which side is doing a better job. some of the
