mr. kerry: thank you. madam president, earlier today during the democratic policy committee luncheons, we were privileged to hear from the c.e.o.'s of three of america's largest companies: dupont, seamens and duke energy. and it seems that it was reaching that point here in washington where folks are starting to line up to argue ideological and nonfactual points of view with respect to one of the major issues facing our country. this is not unusual. every great debate in history, certaintcertainly since i've bee in the senate and well before that, has always been subject to one interest group's or another interest group's intses. and those are often conditioned by phony studies, by one particular industry's funded study, almost inevitably always not peer reviewvmentd an review. and so it is we're beginning to see this kind of a lineup now as a response to the action taken by the house of representatives which passed climate change legislation. and a response to the schedule that the majority leader has put

brown: thank you -- mr. kerry: i yield to the senanator such time as he may ue on behalf of senator bayh. mr. brown: thank you, senator kerry. i want to thank chairman levin for his leadership and senator bayh for his work. this debate is about competition. it's about how our government spends money. earlier this year the senate passed a comprehensive d.o.d. procurement reform law. now we're debating a defense authorization bill of more tha than $660 billion. we need to continue to reform the procurement process. we need to make sure congress is not just a rubber stamp. we're debating today whether we should hand a near monopoly on engines and long-term maintenance for the joint strike fighter to one company. the department of defense created the alternate engine program in the mid-1990's because d.o.d. knew that a program would foster competition between engine manufacturers. competition fosters cost savings, improved performance and flexibility. now we're debating whether the senate should create a monopoly and

mr. kerry: mr. president, obviously north korea's actions in recent weeks, months really, testing a nuclear device on may 25th, and launching ballistic missiles on july 4th, received the appropriate objection in many different ways of china, japan, south korea, the united states, and many other countries. clearly those actions threaten to undermine the peace and security of north ease asia and -- east asia and the united states' response to those actionses ought to be and i believe is already resolute. china responded very clearly. the sanctions had been toughened, individual sanctions for the first time. a number of steps were taken by both the united nations and china. china, incidentally, unprecedented in some of -- personalize -- personally put in some of the sanctions that were put in place. i know that the senator from kansas cares enormously about the underlying issue here. but i have to say that this amendment is, while well intended, it simply doesn't do what it's supposed to do. it has no
