mr. martin. my concern, mr. martin, is that, you know, we have had long discussionses about we want to make sure we have high standard for prevailing wage and participation. we should have seen a lot of these concerns moving forward. what is your response to that? ~ >> supervisor, i would say i definitely hear your point loud and clear. certainly -- and i think the rest of this hearing will indicate, this is a lot of why we want to bring the america's cup to san francisco. and i would, i would like to point out again the commitment to pay prevailing wages on a temporary event, not a construction event, a privately run event, is a significant sort of concession during the agreement. and as you know, supervisor, you were very much involved in the sort of negotiation of the final workforce plan provided by the america's cup authority. certainly if we had it to do over again, we would love to avoid this conversation. but looking at where we are now, i just want to echo what supervisor farrell said. i'm very appreciat

mr. martin or mr. barkley can talk conceptually about what is going on. >> an important consideration for us was that we talked about having 55 days of racing through the summer of -- here in san francisco and that's what we wanted to deliver. so, i'm pleased to say that we still have roughly 55 days of racing through the summer. but to achieve it, we've filled a void with some specialist events. one of them is the red bull youth america's cup, an event called the imagination of the world. there will be 10 plus countries represented with youth teams. we just had some trials here the last four or five spots in february. and the uptake from the media around the world is in actual fact a surprise in terms of how much visibility this is getting for [speaker not understood]. another event that we've added to the schedule is what we call the [speaker not understood] which is where very, very large sailing yachts will be sailing on the harbor. in the bay here, i should say, on the days between the america's c

mr. martin, do you have copies of the presentation? >> i don't with me, but i can ask someone to make them and bring them down. >> great, thank you. >> i'd be happy to. supervisors, just wanted to step up today and provide you with a current budget update. that is alongside the report you're getting on the fund-raising as well as the economic impacts. to similar comments made at the outset of this issue, it's certainly not my office's place to try to recast the agreement. the words are what they are on the page and we're frankly moving ahead to implement the agreement the board approved last march and again in september. we have been trying to do this in what everyone talked about as the san francisco way in terms of upholding the considerationses around workforce and small business that we already heard about today as well as through the environmental review process and really creating a sustainable event that becomes a leader. all of that obviously requires resoartiones, but i realize -- we realize very acutely that it requires smart

mr. martin's take on that and we can move on to the next subject of this hearing. i appreciate, mr. barkley, your coming in today. thank you. >> supervisor, i'm sorry, what's the question? >> well, mr. barkley discussed that prevailing wage is really to be applied in conditions where there is going to be a reimbursement for work that had been done. but now the idea -- that's different from what i had expected our discussion would be today. it seems like we're applying it now across the board for projects that are part of the america's cup event. and i'm wondering what your understanding is where what the original intent was around prevailing wage. i believe it is actually just a standard we've applied for the america's cup project. >> i agree with parts of what mr. barkley said in terms of the reference to the reimbursement for construction works. as i mentioned in my open or opening part of this presentation, we came back to you. the deal was recast as potentially the port doing the work and the port actually did do the work. so, the provision that mr. barkley is referring to is ri

mr. martin. and just before you start, i think -- and i mentioned this earlier, when we began the hearingv, i think it's important that we talk about the original fib tent around raising $32 million. it was to make sure we weren't going to be using general fund dollars. that was the intent of it. so we talk about now we don't have to raise as much money because we're going to be recycling back revenue we get from the hotel tax and from revenue from the event and sales tax, retail tax into pay for putting the event on, reimbursing the city. that to me was not the intent we originally had in raising money through the organizing committee. >> right. >> thank you, supervisors. mike martin, america's cup [speaker not understood] from the economic workforce development. i'd like to get a brief overview, just a little bit of what supervisor avalos just alluded to in terms of the road we took to get here. i would suggest, supervisor, we have john [speaker not understood] from the bay area council economi

mr. martin, just to call you up one last time and then we'll go on to the fund-raising part of this hearing. it seems like we have a report from mr. barkley that there has been some meeting of the goals that we had around workforce, around local hire, around prevailing wage, that's not quite as much informed in a timely way it was actually possible to implement prevailing wage around what happened last year and small business inclusion, but it seems like we don't have any data to show that is actually happening or we can say as a city, this is what happened. so, how can we, looking back, make sure that we're actually not just saying it happened, but proveding that it happened. what do you see we can do to get that information out? >> supervisor, i guess i want to take a step back to some of the things that were mentioned by the prior speaker. i think i really want to express some really innovative approaches that the american way has taken on the small business inclusion piece. as referenced earlier, the ac business connection site of people trying to keep their aye on these business he. ma

mr. martin to talk about how we make sure we actually put our standards in place for what entities are doing [speaker not understood]. it seem like that hasn't been the case. >> okay. what we've done is that the [speaker not understood] participation, we provided them with paperwork, what we call the form 2a, the participation form. all the forms of these proposals have gone out already. we have provided them with those forms, so they have a great staff to provide information to all contractors with whom they have contracted already. so, we go to [speaker not understood] and we can come up with an independent report of our participation of local business participation a compared with the reports. so, we don't have that information from [speaker not understood]. but we met with them and the mayor's office of workforce development, they are willing to provide the information and the procurement plan. that is very crucial for us to measure, you know, to measure the lbe participation and to an advertise the work that is going to come out so we can help them outreach to local business enterprises

mr. martin if we continue this, would be valuable as well. but i did want to just echo supervisor avalos comments that i think that local and disadvantaged contractors are really important in how you insurance that contract maximize the participation of local businesses, but especially disadvantaged businesses. and then, i definitely want to hear more of the rationale for the mag only contract and i know that we will have that for a future time as well. but thank you. >> okay. >> thank you thank you very much, miss winer and we appreciate it. to the budget analyst report. >> commission chairman and members of the committee, as shown in the table on page 28 of our report, under the existing 12-year lease with clear channel which will expire on march 31, 2013, clear channel will pay the airport a total of $72.2 million, with such revenue paid by clear channel, increasing each year and in addition is showing in the table beginning on this year too. but, the percentage of gross revenues and this is a key point that the supervisors exceeded the an

mr. martin. next i'd like to call up donald levitt from the office of labor stands enforcement.fice has been working with the office of economic workforce development, with labor unions, with small businesses, community groups, all to make sure we're maximizing what we can in terms of the benefits for local residents and small businesses and for workers. we've actually found that through thea departments that there have been violations, violations of prevailing wage, violations of the first source agreement, and violations of the workforce plan for local business enterprise participation. i know mr. martin talked about a lot of the -- there was a lot of lead time that the office of economic workforce development had in order to put in place the standard for these programs for prevailing wage first source and local enterprise business participation. but i'd like to say we knew all along these were going to be things we wanted to do as a city. we made a commitment we would have the highest stance possible for these types of programs and we didn't live up to them when it came to th

mr. martine made, was the issue of reduction in transit and other impact fees transit open space, child care, was that something that -- >> in terms of -- >> how did that get -- >> there is a series of discussions and meetings and analysis done before i was on as the full project manager that looked specifically at these larger sites and how the community wanted to handle them. it was obviously an opportunity to provide additional benefits to the community t. was just how do you do that. so, what ended up in the code came out of those -- of that process. >> which was a code of a reduction in the impact fees? >> right. basically a reduction -- basically umu model, reduction of residential impact fees, but an increase in affordable housing. >> great, thank you. >> sure. >> supervisor kim? >> next speaker. >>> gilbert crizwell, here to commend jim meko and the task force, but also my community and my neighborhood of pearl street, elgin park, guerrero, duboce, laguna, valencia and market street who also had input to the task force, attended the meetings of the task force and community meetings.
