mrs. mccarthy, before she says anything, she's a pollutant. she's a polluter. we need to shut down polluters like the folks that are breathing out carbon dioxide. it used to be a joke, judge, that the government has gotten so overreaching that the next thing they're going to regulate the air you breathe. and now we're here. and that's what's happening. but in 1992, there was no carbon dioxide concerns. and now they're using the fact that in 1992, texas was not regulating carbon dioxide as a reason to take over what the clean air act says must be done by the states and local government. so it's pretty ridiculous. "the wall street journal" says these words, the takeover was sufficiently egregious that the d.c. circuit court of appeals issued a emergency stay on thursday suspending rules pending judicial review. one particular item in need of legal scrutiny is the permitting takeover as an interim final rule that is not open to the normal and clean air act mandated process of public notice and comment. as the article says, so much for transparency in government. b

mccarthy era, with one exception. and from 1997 to 2002, when representative burton served as chairman, he issued more than 1,000 lateral subpoenas -- 1,200, i'm sorry. i apologize, mr. burton, 1,200. not gone, not forgotten. once chairman, always chairman. anyway, he issued more than 1,200 unilateral subpoenas in the clinton administration without the on occurrence of the ranking member or vote of the committee. as widely reported, this report led to serious abuses and was abandoned by representative tom davis, a republican who became chairman in 2002. it's true at that rules provide the chairman with authority to issue unilateral subpoenas. representative davis understood that issuing a subpoena is such an extreme exercise of congressional power that it should be undertaken only with agreement of chairman and ranking member or the backing of the full committee. i notice that many of your members -- some of your members are former u.s. attorneys and attorneys, and they can fully, i know, appreciate the significance of a subpoena. when representative davis handed over his gavel to representative waxman in 2007, exactly like we're doing here today, he asked mr. waxma
