mr. mckinley: thank you, mr. chairman. i rise today to offer an amendment that would reduce the threshold for a major rule from $100 million or more to $50 million. this would ensure greater accountability. let's keep this in perspective. i based this amendment on legislation that has already been adopted by the house in 1995 with bipartisan support, to -- which lowered the threshold to $50 million. it passed with a vote of 277-141 . with much of today's leadership who were here at the time supporting it. also in perspective, in fiscal year 2011 only 2.6% of all the rules that were classified as major and in 2010, in f.y. -- only 3% met that criteria. let's keep that in consideration. would you be satisfied with only 2% or 3% of your food being inspected? or 2% or 3% of the aircraft and the rules which we fly? according to the small business administration in 2008 it cost the economy $1.75 trillion in regulations. we just went through a gut-wrenching supercommittee that tried to reduce $1.5 trillion but yet, but yet we let

mr. mckinley, for 1 1/2 minutes. the chair: the gentleman from west virginia is recognized for 1 1/2 minutes. mr. mckinley: thank you, mr. chairman. i rise today in support of h.r. 1633, the farm dust bill. earlier this year the house passed h.r. 2273, the bipartisan coal ash legislation. unfortunately opponents of the farm dust bill believe that nuisance dust in this bill might include fly ash. therefore an amendment was offered and adopted to clarify that the definition of nuisance dust in the farm dust bill does not include coal ash or other compusston residuals. the amendment makes it perfectly clear that nuisance dust is not comprised of any residuals from coal combustion. unfortunately, opponents of the farm dust bill are still apparently unaware of the changes that have been made to the bill to address their concerns. don't oppose the farm dust bill because you don't like fly ash. let's relieve one more threat to our agricultural community with passage of this bill. we should be striving to create more jobs no

mr. mckinley, for five minutes. 7. mr. mckinley: thank you, madam chairman. today i want to announce that company c 150th aviation united of the west virginia national guard are on their way home to their families and should arrive this afternoon after serving our nation for the past 12 months in kosovo. truly there could not be a better christmas present. company c is based in the first district of west virginia in my hometown of wheeling and was deployed one year ago to kosovo on a peacekeeping mission. while overseas, the unit was responsible for all aerial operations within their area of responsibility. company c soldiers, all 2,899 flight hours, 951 missions. they ran multiple mechanical missions and refueling missions and dispensed 246,260 gallons of fuel. the west virginia national guard plays a key role in the defense of our country and interest around the world. america could not be prouder to have these men and women as our representatives. today i'm thrilled to say, welcome home, company c. thank you, madam speaker. i yield back my time. the speake
