mrs. miller: mr. speaker, last week the president came to this house for a joint session of congress to discuss how we as a nation will reform health care. and the debate over health care has made clear that the american people are actually paying attention to what is happening here. during the president's speech our colleague, joe wilson, made a mistake. a mistake that i believe was drisk be by both the substance and the -- driven by both the substance and emotion in this debate. immediately after he made that mistake, congressman wilson did the appropriate thing, he immediately apologized to the president and president obama very graciously accepted his apology. mr. speaker, recently president obama made a mistake when referring to actions of the cambridge police while acknowledging that he did not have all the facts and in the national uproar that ensued, he called it a teachable moment. and i thought that was a very human response to an incident that was blown totally out of proportion, in my opin

mr. miller? >> thank you. last fall when lehman collapsed and aig was rescued, i felt like i was not a conscious member of this committee. i had very little understanding of credit default slots. then i came to realize and no one understood them. that made me feel a little bit better about my own level of consciousness but made me feel worse for the economy and the world. in your testimony, you a did by credit default swaps as something that had exasperated the risk that our economy base. the great bulk of credit default swaps are between parties, none of whom have any risk to manage. they have no interest in the underlying whatever it is. in your testimony, he said some kind of risky behavior should not be allowed of institutions that are systemically important. do you believe credit defaults swaps, where nobody has any interest in the underlying security, should be allowed of systemically important institutions? but let me make a general position. my general position is they make a distinction between banks

mr. miller, is recognized. mr. miller: i thank the gentleman for yielding. i rise in strong support of h.r. 1043, the deafy glade land exchange act, and i want to thank chairman rahall and chairman grijalva of the natural resources committee, the minority, for bringing this legislation to the floor. as was noted, this similar legislation passed by vose vote last congress. the fouts youth facility has been there for nearly 50 years. the bill before the house guarantees they can continue to do their good work. fouts springs has helped rehabilitated california's young offenders with much-needed structure and significant vocational educational opportunities. presently, solano county operates fouts springs as well as other california counties under special youth operation. this legislation, the deafy glade land exchange act, would give solano county the 82 acres they use at fouts springs and exchange would give the mendocino national forest of 160 acres of nearby lands known as deafy glade. they have access to the snow mountain wilderness areas and has been part

mr. ambassador, if i could skip back to china. kind of of follow on to the answer you gave to colonel millard's -- miller's question. i've heard a lot about the code of conduct from the south china sea. i think that was signed in 2002. in any event, it has been in place for a couple years now. how is it working? >> 2002? >> [unintelligible] >> i was the one who worked on that. we signed that contract, because by that time i was the sub- leader of international affairs. they wanted to have a code of conduct. finally, we agreed with china, because the chinese wanted to have doc. we wanted c to weoc.-- have coc. it is a different technology. >> what does the "d" stand for? >> declaration of conduct. that is different than code of conduct. code of conduct is more legal. declaration is formal. still we are working with china to move from doc to coc. it is not easy. we are still in discussion. doc -- with d.o.c. in 19920 -- the countries concerned are more or less restrained from threatening the people. we respected or recognize the conflicts with the claimants has been deduced. believe me. i cannot tell what will happen
