mr. murphy: thank you, madam president. next week we will mark the three-year anniversary, for lack of a better word, of the massacre at sandy hook, connecticut. and senator blumenthal will be joining me on the floor momentarily. and i wanted to come here and speak to our colleagues for a few moments about what this week will mean to us in connecticut and the challenge that it presents to all of us. i want to open by talking about one of the young men who perished that day, a little first grader by the name of daniel bardon. daniel was a really, really special kid. i talk about him a lot when i'm speaking on sandy hook because i've gotten to know his parents pretty well over the years and so i feel like i know daniel. pretty well. now that i have a little seven-year-old first grader at home, too, i, frankly, feel closer than ever before to the families like the bartons, who are still grieving. daniel had this uncanny sense of empathy, that now as a father of a seven-year-old, i know is, frankly, not normally visited upon ch

mr. murphy, who is leon crane? who was leon crane? >> guest: oh, it's an amazing story. this is a kid from west philadelphia, was assigned to an air base outside fairbanks. the year is 1942, winter of 1942. and what they were doing at the time, among other things, was doing cold weather testing of aircraft. and the idea was that they were worried next war front might be greenland, norway, manager like that. something like that. so he went up with four crew members and himself, five members on the plane in a b-24 bomber, and they were going to do something called prop feathering which is closing down the prop and trying to make it more aerodynamic. so, basically, shutting down an engine. the plane went into a spin. he bailed out, leon crane, lieutenant crane bailed out through the bomb bay. another person dirked as well, but e -- did as well, but he certainly died leaving the aircraft. it was -70 probably at that altitude. and crane parachutes down, lands by a frozen river. the plane is burning up on a hill, and for the next 81 days being considered dead by everyone, the

mr. murphy. >> how are you doing? >> i'm fine, sir. was it a fair trial in your opinion?both sides got an adequate opportunity to present their cases and the jury selection appeared to be fair. it was a representative jury of a cross section of the baltimore community and black judge who was misconduct what more you can ask? >> you don't have any beef with how the trial was conducted. in a hung jury we don't know what the polling of the jury was. like how many people wanted to convict and how many people wanted to acquitment, is that correct? you don't know that? that's correct. we don't know. we doe doo know the prosecution was able to convict some of the jurors there was proof of a reasonable doubt of some of the crimes that were committed and we do know the defense was able to convince some of the jurors that officer porter was innocent. >> okay. now, in cases like these they will have to be retried and then the prosecution has advantage i understand 69% of retrials end in convictions; is that correct? >> i would be more cautious than that i would say majority of time
