mr. nichols and others. they deserve our thanks. i believe they will support bipartisan efforts to prevent such abuses and punish those who commit them. as i mentioned tyre nichols loved photography. he loved photographing the world as he saw. one of his favorite images which appears again and again and his photos is the image of a bridge. it's time for members of the senate to bridge our differences and pass a policing reform so tyre nichols' death will not have been invaded. madam president i ask a statement on the debt ceiling that i have be placed in the recordin.bjection.. >> i will yield the floor. >> madam president, the killing

mr. nichols and then the time in which emt personnel arrived and other elapsed time before nichols is taken away in an ambulance and asked about the length and appropriateness, people can judge for themselves. with respect to the fire department persons, nothing we did yesterday concludes additional charges for being filed later on against other individuals. but as to the likelihood of that or, you know, whether we're looking at that, those are the kinds of details that i really can't talk about with respect to an ongoing investigation. >> can you talk -- if you can't characterize the period of elapsed time, can you tell us how many minutes lapsed between when injuries were apparent with tyre nichols and officers on scene called for an ambulance or a period of elapsed time before the ambulance got there. can you tell us in a matter of minutes. >> i hesitate to give numbers, but there were multiple minutes between each of those things, and a few short hours, people will be able to find out exactly. >> we know all five officers have now bonded out of jail. only four had done so previously. th

mr. nichols' family, the city of memphis and the country deserve nothing less.pray for justice, healing and eventual closure for all involved. no singling out of the officers. no mention of them, the indictments, the firings. is this a strong enough statement? sheryl? >> understand that these unions are there to protect the officers. so they are in some instances the lobbying arm of police departments in terms of rights of officers. they gave a politically correct and wanting to seem sensitive statement. but understand this. that police department and that city has a real problem. now that we have had over 24 hours almost coming up on 24 hours since that video has been released, i have so many questions about what that department did really to prevent this, all of this was preventible. you have officers young on the job, unsupervised out there doing what they do on a regular basis. this was not anything that they aren't accustomed to doing. they were sophisticated and savvy. they created an audio record to manufacture probable cause for the initial stop and ever

mr. nichols. ship after some period of time he was taken away by ambulance beyond that i don't think we should go into any further details. >> reporter: wolf, two key new pieces of information the district attorney there released saying that tyre nichols was pepper sprayed in the initial encounter. something else went on there. also significant is the fact that it took time to get him the medical care, as you heard there, the d.a. say. we also learned that the unit that these officers were a part of, it's called the scorpion unit. an anti-crime unit. they ride around in unmarked cars, plain clothes. they are, they don't wear uniforms but do have gear on them that would indicate they're police, but that's also significant in how all of this is now playing out, and now obviously the d.a. also saying there could be more charges coming as this investigation continues. >> stay with us. also bring in our legal and law enforcement experts for more analysis. john miller, start with you. all five of these

mr. nichols.have to let his legacy, his sacrifice, the sacrifice that his mother would not have her son anymore, we cannot let this go unaddressed. we cannot let this go unaddressed. so, you know, i hope that -- well, i'm sure that my colleague will stand with me. we're going to have to have some tough conversations. as i've said before, if people want to make -- want to say that these were black officers on a black man, but i go back to some words that iden've said previou. it's the culture of policing that says when you have a black motorist, we can treat them any type of way. you know, there's -- we just have to change the culture of policing. we have to hold people accountable. i give a lot of create to d.a. mogul. i give credit to our police director, because we addressed those officers, we fired them very swiftly. the d.a. brought the charges to these officers. so we have to address this. we have to let the legacy of mr. nichols be police reform, not only here in memphis, but in this country

mr. nichols next wednesday. but between now and wednesday, i think that the tape and the questions of how this could have happened is something that's going to resonate around this country. and the fact that they were black officers has not in any way shape or form lessened our outrage and our understanding with this family. we have been am constant touch with them. they will be holding a press conference with the lawyers in the morning. they don't want violence, but they do want justice. and i think before everyone projects what may happen in terms of a violent reaction, let's not forget the violence that took this young man's life, must be held accountable. charges are good, but charges are only the beginning of a process, not the end. >> you talk about the process, and you talk about the questions that still need to be answered, and something that has is standing out here is this question, antonia alluded to it is, what happened after that second altercation, because the d.a. seemed to drop a lint about that,

mr. nichols.ve that those officers actions clearly escalated that situation, and by the end of the video, i saw police officers who got caught up in the emotion of that pursuit, and lost control of themselves and lost control of the situation. >> john miller, plausible explanation from michael there? taking a step further what did you see on ground not getting the treatment that as sanjay was saying before he obviously needed. >> first dealing with the police officers, there's a lot of screaming and yelling but doesn't seem to be much tactical planning on the case of mr. nichols, they keep saying give us your hands, give us your hands, clearly he doesn't want to be handcuffs, clearly he doesn't understand what he did or why he's being arrested. there are a number of tactical ways to go with that, one you could handcuff one wrist and have an officer maintain that arm, get the or wrist, bring the wrists together, there are arrest tactics this seemed to spiral out of control with a large number of of

mr. nichols. i think as a nation we have to understand that at some point we have to accept the fact that it is the entire system. the entire system needs to be changed. we have to shift from a culture of accepting excessive force, but to going into these police departments and making culture changing decisions. >> really important point, councilman, thank you so much, i appreciate your time this evening. >> thank you for the opportunity. you know, the idea of never again to once again. here we are. five fired memphis police department officers have each been charged with second degree murder and some are questioning whether prosecutors can make that charge stick. while shelby counties da, stephen mulroy, he is bringing these charges and saying this about it. >> under tennessee law, in order for one to prove there is a knowing killing, the only thing one must prove is that one acted with a course of conduct whereas the defendant was reasonably certain that death may result. and we believe that all

mr. nichols was not correct. it was not right.ave happened and hence it was a false imprisonment. >> that's so interesting, sergeant dorsey, because we were just discussing the stop, the traffic stop. so many questions surrounding that and what bernarda is describing seems to skate that there are some questions here about why that stop occurred. and whether or not the reaction by police to the stop was warranted, as well. >> well, you know, like i said earlier these officers are assigned to a special unit, the scorpion unit according to reports and so what happens what they're charged with is being proactive, in other words, not responding to radio calls like a normal officer would do but be out there looking to see if you see anything that seems in your mind suspicious looking for a stolen vehicle and so they're running plates, and anything that would be a violation of the vehicle code would giver them a pretext reason to initiate a stop and then, of course, we hear according to the audio a foot pursuit pursues and officers tryin

mr. nichols was in their custody. officers commanded mr. his hands even as they were holding his hands. told him to get on the ground even when he was on the ground. and they ordered to him to reposition himself. the memphis police department announced that a sixth officer has been relieved of duty. five other office verse been fired, charged with murder. the unit they worked for the so-called scorpion unit was disbanded over the weekend. all of this as a push for justice, it's hard for the family of the late tyre nichols. here's tyre's mom. >> i feel like my son was sacrificed for the greater good and it's going to be a lot of good that comes out of this. hopefully we can help another kid and another family not go through something like this. my son will always be remembered and i will continue to fight until justice is served for him. >> join our coverage, senior opinion writer for the boston globe. eddie glaude is back. paul butler is back, former federal prosecutor, now a professor of law at georgetown university. i will say, i don't thi

mr. nichols to the ground is the first problem. you have to drive it out by -- frankly for number people on the scene, tear larger point. anyone could be the poster child of what never to do. hope to never do in a civilized society. let alone those who wear the uniform and profess to be peace officers. i do wonder, though. one of the words we often hear when we talk about officer involved deadly encounters. is that there are questions about, not only, police morale and recruiting. but also the safety of the community. if officers tend to have some sort of a backlash, or retaliate through inaction it down the line. do you see anything like this happening in memphis right now for offices, or as a culture, or as a community of a force. are somehow approaching this as hands off, and not wanting to do the work? >> not at all, but i think we look at it and the greater context. i think is a nationwide shortage of police officers already. but the officers that we do have they take their job very seriously. they're not taken a hands off app

mr. nichols. but one question that has not been answered is, where was the control, where was the sergeant, where was the person that has a responsibility to ensure that younger officers, and we are learning the most of these officers had only been on the force less than five years, where was the person with the experience that should have pulled them back, should have prevented them from engaging in that unconstitutional behavior that we saw demonstrated on those videos? so, lots of questions about the lack of supervision and the policies that have been implemented by this police chief. i know the police chief has gotten a lot of credit for acting very swiftly in terms of firing the officers. the district attorney has got a lot of credit for moving quickly with the charges. but i think a lot of questions were raised about the policies that allowed this unit to exist, and the other complaints that we know have been filed by citizens against unit. how are those complaints treated and wherever those

mr. nichols.edical examiners around the country, and that was the area they pointed to, these blows to the head. it's worth noting that he is a pretty skinny guy, from what we understand, and there were kicks to the body, to the torso, to the chest as well. and any of those organs may have actually sustained damage and started bleeding as well. could have been suffering from internal bleeding at the time that all of this was happening. and that brings us to the next point, which i think is critically important. when you look at sort of the timeline of what was happening, around 8:33 or so, 8:34 when you see this last kick that he sustained and then he is handcuffed and dragged over to the car. then it's eight minutes later before we see e.m.s. even arrive. but it's not until around a half an hour almost in total before you see a gurney arrive. a critically ill man lying on the sidewalk, sustained all these injuries. hard to say the extent of the injuries or how serious they are at this point. what

mr. nichols. officers do what they do on a regular basis, promise you find out in the future there will be others that come forward and talk about the kind of abuses that have suffered at the hands of the s.c.o.r.p.i.o.n. unit. the name alone is offputting. these officers understand great deference given to their version of events. we heard start to finish manufacturing probable cause, lying about the encounter creating audio record because they understood they were being recorded when they said, he was really strong, all 140 pounds of him. when they said he was trying to take their gun, when they lied and said he tried to hit them in the midst of committing an infraction, reckless driving. then do know his mom said, officers came to her home and said her son was being treated at the hospital because he was a dui and taken to jail and booked him knowing he was not able to be booked because of his injuries. it was not until hospital staff called and said, do you know your son is here, why aren't yo

mr. nichols' parents, his mother and stepfather, i want to return to the point major franklin made. i want you to listen to ben crump. we'll see what he says at this event but mr. crump, we have seen horrific episodes of police violence against black americans. listen where he describes the blueprint point that major franklin said here is a department, yes, there's pain, yes, there's incredible anger but this one is different. listen. >> this is now the blueprint for america when you see officers committing crimes on video, then you can't tell us that you got to go six month, you got to go a year, the tamir rice, the michael browns, ahmad -- all these cases took so long, philando castile, in memphis we have the blueprint that it can be done swiftly and efficiently. >> at these moments, you hear the litany of names everybody should ratemember, you have covered many if not most of those and been to uvalde and been through this. how does that make it different that the police department here, again, the family and everybody around this is mad, they are angry, they have pain but seem to

mr. nichols doing that would have you in that imminent fear.then the next question becomes, where your actions as an officer proportionate to whatever threat you perceive that was posed to you? then the final thing would be, did you act reasonably and responsibly? so, any type of defense is going to have to be predicated around those things and if the actions were unreasonable, it's going to be problematic. last point, you could look at this and as -- we base things upon precedent. star -- it has been decided. you look at a case like rodney king, how did they get out of that? they put officers in defense, they were able to justify every blow with respect to the conduct of mr. king at the time. in an instance like this, particularly where there are indications, john, that he was handcuffed and didn't represent a threat, how would they overcome that? so, these are all things that i'm going to be looking for and analyzing when i look at the tape tomorrow. >> it sounds obvious, but the defense may very well depend on what exactly is on that video,

the police chief now says they have no evidence mr nichols was driving recklessly.ffic stop. and many other questions remain, why did the police officers used excessive force, and why did so much time passed before he was given medical help? memphis and other cities across the us are now bracing themselves for protests and officials all the way up to the presidentjoe biden have urged the public to remain peaceful. the chancellor has set out his long—term plan for boosting the economy. in a speech in london, jeremy hunt ruled out tax cuts, saying that the best thing for the public would be to halve inflation. his comments came after a week in which the government has faced accusations of having no long—term plan for growth — with some mps continuing their calls for lower taxes. but the chancellor said his focus was on making the uk a technology superpower, as our economics editor faisal islam reports. whether it's robots that can sort your waste, bots that can author human—sounding scripts, essays, poems even, or programmable versions of yourself. every aspect of the

mr. nichols to be stopped. that another unarmed black man died in the custody of police during a routine traffic stop says everything we need to know, which is that policing in this country is in crisis. >> you know, shimon, the city wanted these charges to be announced before the actual video, which is brutal, was released. has that helped ease anger and anxiety among members of the community? you're there for us. >> reporter: well, for the most part, things have been very peaceful here. people are just -- it's just another day. certainly there's a lot of emotion, you go to the store, the restaurant, anywhere you go here, you can feel there's emotion, there's some tension. but we haven't seen any kind of influx of people to indicate, like we have during some other situations, where people come from out of town to protest or anything like that. we've not seen that. for the most part it's been a very quiet downtown here in memphis and people have just proceeded with their day. certainly this is on the minds of e

mr. nichols, those are the ones being charged criminally. of course, it's up to a state's attorney to determine whether or not it rises to that level beyond those five, but certainly there will be administrative action, no question in my mind. >> right. and, chief, i want to get your perspective on this s.c.o.r.p.i.o.n. team. it's a unit that all the officers charged in his death were members of this unit. do you think that played a role in the intensity and brutality of the attack? >> well, you know, there's a couple of things i'd like to mention about that. first of all, the name of the unit, that's not unusual to have a unit named in a way that you would kind of wonder why, you know, s.c.o.r.p.i.o.n. i mean s.c.o.r.p.i.o.n. is a predator with a deadly sting. why would you want to name your unit s.c.o.r.p.i.o.n. to zbiv with. aside from that, if officers are chosen to work in high-crime, high-intensity areas like that, are some of the officers who make a lot of stops, a lot of arrests, things of that nature, but you have to carefully scree

mr. nichols. he died of some other cause.secution needs is one juror to go with them. jurors are often sympathetic to police. but, we have to give the movement for black lives credit because, it is responsible for these officers being fired so quickly. it is responsible for the fact they are criminal prosecutions, it is responsible for the fact there were not violent protests last night, because what the violence usually about is getting officers charged. and, because of the success of the movement these officers were charged. >> one thing keith ellison said last night is because of the success of the movement everyone sees these videos now. which, in jury selection can be seen as prejudicial. >> it may be seen as prejudicial but you would not want a juror who did not respond to this video with human empathy, that does not mean that they can't put aside their emotion and judge the case fairly. >> thank you for your help and analyzing this we always appreciate it, sorry it is always about things like this, professor george tow

mr. nichols should still be alive and that the tactics and approach of these police officers was patently deplorable. >> sanjay thank you, i want to get into this a little bit with you, i want you to put up some video and get your takes a a medical expert. let's watch. this is the sky camera from above here and what you're going to see this is within that four-minute period where these officers seem to strike him i think nine times, i believe that's what we're looking at here. or this may be something else. can you guys tell me at the control room what we're seeing here? this is different, this is aid not being given to him. this is emt apparently on the scene, what are you seeing them doing or not doing? >> well, so this was one of the more troubling parts of the whole thing, it's all so troubling. i look at this very carefully and sort of marked the time. because there's a time code in this video, and the last time that mr. nichols is assaulted is kicked is around 8:33, it is not until 8:41 we see looks like a fire truck, ems pulls up and nothing happened until 8:55 where someone assess

mr. nichols. pepper spray was deployed. the suspect -- or not the suspect, mr. nichols, fled on foot. there was another altercation at a nearby location at which the serious injuries were experienced by mr. nichols. after some period of time after waiting around afterwards, he was taken away by an ambulance. beyond that, i don't really think we should twogo into any further detail. >> there was a delay for the police calling the ambulance? >> there was an elapsed period of time, but if you watch the video, you'll be able to make that judgment for yourself. i'm trying to fgive everyone a chance. >> i'm from cbs news. is it known if tyre nichols had previously known these former officers? >> we have no information to disclose about that at this time. i don't know why chief davis isn't here. >> sit just body camera video, or dashcam video, surveillance? what kind of video? >> the actual release will be up to the city of memphis. my understanding is it'll be sky cop video and body cam video. >> one mo

mr. nichols is. what we clearly have seen are professionals, it starts with the professional police officers engaged in criminal conduct, alleged criminal conduct that obviously contributed at the very least that caused mr. nichols' death. then you have other professionals who are emergency responders who obviously, based on the information coming out, have, you know, really was dereliction of duty and responsibility. whether or not it is in your policy, written down or not, or whether or not there is a law, it is implied, it is built into both law enforcement community, and our emergency medical responders and our fire department, we have a duty to care. and a duty to intervene. and i think on both of those levels, these professionals failed miserably. and now, you get a better understanding as to why it is important to say, not just the slogan, but to support the organization, that black lives matter and that can't be ignored in this case, that we're talking about, once again, a black victim who wa

mr. nichols family saying tonight?think it is important to mention that the family has seen the video, it affected them obviously significantly, the mother saying it was difficult for her to watch, and she said she could hear mr. nichols in the video saying, what did i do? the family put out a statement through their laura you're saying come of this young man lost his life in a particular disgusting manner that points to the desperate need for change and reform to ensure this violence stops occurring during low threat procedures like in this case, a traffic stop. adding it was it absolute definition of a needless death. we will keep saying his name until justice is served. the lawyers have mentioned that they are grateful that the five officers have been fired, that the investigation and the subsequent charges were expedited to make sure that there is accountability, but of course they're quite keen to see this through until the end. laura: that video will be released to the public tomorrow, by firing these officers an

mr. nichols.se his -- tases him, and he uses an expletive, and says he hopes that the officers pursuing mr. nichols, that they stop him. but he was never present at the second location. he has been relieved of duty. the memphis police were -- police department won't say whether he will be permanently terminated her face charges. his lawyer says he's cooperating with the investigation. he's been with the police since 2018. when you look at the total number of people affected by this case, altogether 10 people at the scene have been fired, including the five black police officers who beat tyre nichols, or relieved ofuties, including two deputies and two fire department employees. anchor: tyre nichols's family e going to be guests at the white house, but not manyolice reforms. reporter: yes, tyre nichols's mother says she wants greater good to come out of this. the family lawyer, ben crump, says shame on all of us if nothing comes out of the death of tyre nichols. they tried to pass the george floyd

mr. nichols. videos alongside medical examiners from around the country, and that was the area that they really pointed to was these blows to the head. but it's also worth noting that he's a pretty skinny guy from what we understand, and there were kicks to the body torsion the torso, to the chest as well, and any of those organs may have actually sustained damage and started bleeding as well. he could have been suffering from internal bleeding at the time all this was happening. and that brings us to the next point, which i think is critically important. when you look at sort of the timeline of what was happening there, it was around 8:33 or so, 8:34, when you see this last kick that he sustains, and then he is handcuffed and dragged over to the car. and then it's eight minutes later before we see ems even arrive. but it's not until around 9:02. so 20 minutes after that. 21 minutes after that, almost half an hour in total before you see a gurney arrive. so you have a critically ill man who's lyin

mr. nichols was beaten to a pulp.ith according to the police chief who spired -- who fired the police officers quickly after seeing the video which the press has not. where the police officers basically through any rule and humanity out of the window. and they hurt mr. nichols soda -- so badly that three days later, he expired in the hospital due to excessive bleeding and the beating. brent: the family of terry nichols has gone public and lead with the public to remain calm once the video is released. we are hearing from a lot of people even the chief of police in memphis saying that what people will see is more than appalling. they are saying is worse than the rodney king videos that people might remember from los angeles back in the 1990's. are we looking violence this friday night? >> absolutely possible. not only did police in memphis are on high alert, not only this city is on the edge, that is across the nation. the fbi has informed all field offices to be on alert. all sheriff's office and county across the uni

mr. tyre nichols while he was on the ground, mr. nichols gets away.ut if you pay particular attention to what it said, the officer says when they catch him, i hope they stump him into the ground. i think that is the culture. if we want to make systemic change with policing, we have to address the culture. i think we do that by making complete, comprehensive change as it relates to policing. >> what about the police chief, though? do you think she should keep her job? >> well, i can't speak to that. one reason, she's been here for less than two years. she's come in and attempted to make change. but i think it is time for her to shake things up. she's on the clock. >> we were just interviewing a former nypd detective who said in some places they've now put restrictions on police officers when it comes to like low-level like traffic stops. they're no longer involved to be involved in them. we saw how a traffic stop led to the death of tyre nichols. do you think that should happen in the memphis police department? >> absolutely. in the city of memphis, we

mr. nichols, but knowing mr.ills and the kind of person he is, i cannot imagine he has anything other than feelings of grief for this family who has lost somebody. i understand we are defense lawyers. we are representing people accused of causing somebody else's death, but that doesn't mean that we're not aware of the fact that there's a lot of pain from nichols family and in this community. we and our client -- not to speak for mr. massy, but i and my client, mr. mills, are well aware of that. >> all of us are and the state has this matter indicted and there are numerous allegations made against all the officers. and i watched the conference today. i thought general mulroy did a nice job of presenting his side to the media and he asked for justice and we agree. justice means following the law and the law says that no one is guilty until a jury says they're guilty. so that's the process. that's going to take a long time. eventually the state will be able to place their case in front of a jury, group of citizens f

mr. nichols. after some period of time of waiting around afterwards he was taken away by an ambulance. >> reporter: after the incident earlier this month memphis police released a statement saying nichols was pulled over for reckless driving and that as officers approached the driver of the vehicle, a confrontation occurred and the suspect fled the scene on foot and said after another confrontation nichols was taken into custody. but complained of having shortness of breath at which an ambulance was called to the scene. nichols died three days after that stop from his injuries according to the tennessee bureau of investigation. less than two weeks after the incident memphis pd fired five officers after an administrative investigation found they violated policies including excessive use of force, duty to intervene and duty to render aid. two members of the city's fire department were also fired. the police officers fired days before the nichols family and attorneys were shown the video. >> no father

mr. nichols. did you see what the police officer said in contrast to what mr. nichols said, f bombs and this and that and get out? is that the way you should be comporting yourself with respect to interpersonal communication. in the event that you're going to engage in conduct as an officer and you're going to actually use force, is there an immediate threat that anyone sees that is opposed to the officers. if you look at the officers conduct, is the conduct the officers engage in proportionate to what mr. nichols is doing? can we say they acted reasonably? and finally with respect to their failure to do anything but stand around and make excuses, it's deplorable. when jurors are evaluating, if it gets that far, the issue of first degree, second degree -- there's not a first degree, we know that. that would require proof of premeditation. the prosecutor opted to prove a knowing killing. what does that mean? it means you have to know and appreciate the nature of what you did could lead to what is a death here. we saw on that video deplorably strikes to the head,

mr. nichols' family.epartment of justice cares deeply about potential violations of constitutional rights here in memphis and throughout america. i i said we have opened a criminal civil rights investigation. i told them this federal civil rights investigation will be thorough, it will be methodical and it will continue until we gather all the relevant facts. as with any other federal investigation, we will go where those facts take us. i delivered that message to them, and i want this community to hear that message as well. as i told mr. nichols' family, our federal investigation may take some time. these things often do. but we will be diligent and we will make decisions based on the facts and the law. my office is working hand in hand with the civil rights division in washington as well as the fbi and other law enforcement partners. our team includes very experienced federal prosecutors from our office here in memphis. it includes very experienced fbi agents that from the fbi memphis field office, and
