mrs. shea porter yields back. mister russell. >> i think one of the reasons i will oppose this it assumes that there is a unfairness in the uniform code of that. quite the contrary. it's one of the most remarkable systems of justice in the united states. i've been a former commander and i've had to serve in court marshals. the problem i have it with the language particularly where it stated online six and seven with regard to convening authorities is that it would not allow them to select a balanced construct of people with the rank and experience for example particularly the case on war crimes tribunal. you have a serious charge that could have resulted in a capital offense. if the individual was found guilty. it happened in a combat environment and as such there had to be a very strict experience level and apportionment that would be the makeup of that court martial. and the convening authority have the ability to do that. random selection of that would not have provided that mix i think we can continue to work
