justice roberts: thank you. mr. brownell: mr.f justice i would like to make three points to support my colleagues or commit. to begin, power plants are the most recommended source category under the clean act both before 1990 and after the 1990 amendment. it's not only title for acid the positive -- acid deposition program, but a visibility, best available retrofit technology, pollution transport grants targeted at power plants, and a variety of control programs, both quality and air quality. justice kagan: i would think that cuts the other way that every other significant industry in the u.s. is subject to this program except or electric power plants. -- except for electric power plants. mr., brownell: what it shows is that for other industries epa instigated in 2010 that for all other industries, the air toxics program that would impose compliance costs of about $840 million. the single regulation now on air toxics imposes annual cost of $9.6 billion. and what does one get for it? it think it is important to understand some of

robert durst, not guilty. >> did they say not? are you sure? joining me now is the judge that red that verdict. retired texas district court judge mrs. chris. your reaction to what that happened in the last 24 or 48 hours? >> you always have to expect the unexpected with robert durst and the things going on in his life. every time you think it is as shocking as it could being with something else happens that lets you know this case is so far from being over. >> you sat in that courtroom, and that trial is taken by many as a lesson in the ways that someone with ample resources can get something out of a justice system that someone without resources could. is that fair when you look at the defense of a man with millions of dollars who admits to dismembering his neighbor and walks out a free man. >> he can certainly afford the best lawyers in the state, if not the country, and they did their job, no question. that is not why he won his trial in my opinion. he won that trial because the state didn't do their job. they came to court unprepared. they were -- they had not thought in advance of what questions they would ask. they challenged nothing

robert doll the owner of doll vineyards allegedly fired the shot. the press democrat says the man killed at the vineyards was -- who was in a dispute apparently with mr. dahl. >>> now accused of murder after what sounds a lot like a con fedex was caught on -- confession was caught on tape. we have the story. >> reporter: tonight the brother of robert durst's first wife thinks the walls are finally falling in on the 71- year-old. jim mccormick's sister kathy disappeared in 1982 after she and durst fought and had never been found. detectives were preparing to interview durst's friend susan berman when she was shot in her home days before christmas. >> i mean in my heart i said bobby is eliminating the witnesses and people who had the knowledge. >> reporter: saturday agents nabbed durst in the lobby of the new orleans hotel. he was staying under a false name carrying a gun and preparing to flee to cuba. his case and audio which some claim is a confession were recently featured in an hbo documentary on the eccentric millionaire. >> killed them all. of course. >> reporter: la prosecutors announced today durst is charged with capital murder and could face
