mr. sanchez? >> thank you. good afternoon. i would like to begin with a brief overview of the timeline of the enforcement issues here. we received our first complaint at the end of march 2010, march 31. there was a self-service operation when the permit history only had them operating as a retail coffee establishment. on april 21, the department issued an enforcement process, which is the first step of the process to determine if a violation exists. that was on april 21. in may, department staff made contact with the appellant and had several conversations about what options existed. it was determined there were a small self-service restaurant operating illegally. we looked at how we could help them come into compliance with the planning code. we set a conditional use would be an option to legalize in place, or they could relocate to another facility. it is my understanding the appellant considered moving to other facilities but ultimately decided to submit the conditional use authorization. that was submitted

mr. sanchez. >> thank you. scott sanchez, planning department staff. i think the presentation given by the project sponsor has been very thorough. i am lucky to be joined this evening by the planner who handled this. he is one of our neighborhood planners with excellent knowledge of this project. he will be able to get into detail with any question. on february 11, they certified the environmental impact report. at this hearing on the 10th, the planning commission also unanimously approved the office allocation for the project, the exceptions, and the variants granted for the project -- variance granted for the project. that has five findings which must be met and much show a hardship, versus the exception. that would consider a variety of criteria set back in the planning code. i would like to highlight two of the exceptions. i would like to talk a little bit about the goals. the tower separation is in order to assure there can be distinguished form. this is a corner lot. on two sides, it does have of this tower separation. one side has a courtyard. i

mr. sanchez? >> good evening, members of the board. i would like to add a few items. the city inspector give you a detailed outline of some of the permit processing. this is located within a residential-commercial high- density zoning district. within this district, retail uses are principally permitted. when the building permit was filed on may 21, the planning department reviewed over the counter. there is no notification required. it goes through over the counter. the board of appeals received a district -- a jurisdiction request on may 14. on june 30, the planning department said there were two permits related to work on the ground floor. the pharmacy is a principally permitted use. the second was a permit for work to convert a dwelling unit on the ground floor to a lottery and storage area. we did have records related to the ground floor, related to the activity in the front in the commercial area. in regards to the approval process for this, it is principally permitted. however, there is still discretion. all building permits are discretionary other than certain

mr. sanchez. it would not reduce the historic value. this kind of onslaught of serial permitting is not how many. that seems to be an issue. what was the intent? i think an entity which receives that kind of money from federal public sources shall live up to their obligations and not carry on a campaign of circumvention and omitting what their obligations are to be met. it is like almost declaring a war on the city. a famous sixth century bc general that was well known even today among military strategists, i will replace the word city -- the word army with the word city. if you expose the city to a long campaign, the city of's resources will be inadequate and their spirit will be depressed. when their strength has been expended and resources consumed, then we will take advantage of the exhaustion to prevail. it is up to you that you have as a board, denied the respondent in these events before the board. this is a continuation of the same tactic used again. the watchdogs of the city approved and in some of the failings of the letter. >
