mr. scott: mr. speaker, i yield two minutes to the gentleman from georgia, my cousin, mr. scott. the speaker pro tempore: the gentleman from georgia is recognized for two minutes. mr. scott: i'd like to thank the gentleman from south carolina, i look forward to visiting the family at christmas. mr. speaker, ladies and gentlemen of the house and this great country, as i traveled cities like covington this past week, the main issue i heard from constituents is their growing fear of the side size of government's regulatory burden on their business and their way of life. now, i find it laughable that today democrats say that they didn't know this 1099 provision was in this bill. the fact is, this 1099 provision was part of a continuous assault by the democratic party on small businesses across this country. now, eliminating this provision will further reduce the government's burden placed on these small businesses and as a small business myself, i know that passing this resolution will allow employ

mr. scott: mr. speaker, house resolution 129 provides consideration of h.r. 4, the small business paperwork mandate elimination act of 2011. if you are looking for a prime example of government regulation which first is an unnecessary intrusion on small businesses, second, enlarges government bureaucracy at the expense of taxpayers and entrepreneurs, finally creates a mountain of mind numbing paperwork which has a net effect of killing jobs, then look no further. section 9006 of the health care reform bill does all that by requiring businesses to report every expense that they incur over $600. not just in wages for their employees, but even for payments to other businesses and merchandise. imagine, if you will, a small business that picks up a couple of dozen doughnuts from crispy cream on a weekly basis, at the end of the year they must send a 1099 to krispykream. think about the small business owner who buys stamps from the post office and now you have to send a 1099 to the u.s. post office. what

mr. scott. >> mr. space? >> thank you very much, mr. chairman. welcome, mr. secretary, and i wanted to just make a couple of points on the options that were presented in the obama administration's report. for one, it says that option one particularly on the privatization -- i would like to know if you're concerned about whether or not private capital can meet the needs of the housing market with any kind of sufficient liquidity. it seems to me to be unclear whether or not there is enough private capital willing to fund such a system. because under this option, the report is running on the assumption that of the government support for the housing market is eventually removed, that the private money will replace. that's what we hear from our friends on the other side. however, if there is no guarantee this will happen, how can this option be flyable? isn't there a risk that the amount of private funding for the mortgage market will be substantially lower than the demand for mortgage loans? and th

mr. sanchez? >> scott sanchez, planning department. i really do not have much to add. we have applied this consistently. to my knowledge, the other banks that have been created recently, the chase bank on fulton,. -- had that been subjected, it would require section 312 notice, at least, because that was prior to the conditional-use of four retail uses. -- it conditional use for retail uses. there are other banks. no conditional use. there was an item heard by the planning commission. the planning commission did not -- may be the zoning administrator answered it, but that was something that was accepted by the planning commission. that is not a formula retail use. it was stated in our case report it is not a formula retail use, and the planning commission denied it for other reasons, and we have been very consistent in our application. i understand is a disagreement between the appellant and the department and how we are applying this. i respect the appellant and appreciate his argument. however, we simply have a disagreement. we deal with financial-services, not liste

mr. sanchez? >> scott sanchez, planning department. there are two main issues. this was identified that next to one building, and architecturally significant building, this is not a landmark building. this was a survey from 1976, and not all of the buildings that are listed our resources but probably, as we spoke with preservation staff, 90% or so, it definitely would be considered historic resources, so when we are viewing this, we did know about it. that is why it was routed to us. he indicated that he was aware of these issues. this is not a feature that was located on the building. it is located adjacent to the building, and in reviewing it, there are those conditions of approval to try to address any potential impact that there could be on the building, and we felt that those were added conditions -- an adequate conditions to address, with the facility being located next to resources. so we are left with compliance. we have a building permit that was properly reviewed, was properly issued, but we still do not, i think, have a good answer as to why it was bu

mr. scott: thank you, mr. speaker. and to my colleague from georgia, i want to thank you for your lead on this and for sharing your time with me. members in november wanted us to get our fiscal house in order. in fact, our very livelihood as americans depend on it. now, americans understand and we as republicans understand that we cannot eliminate this deficit with one piece of legislation, but they do expect congress to work continuously to reduce spending, excessive spending in all areas of the government. mr. speaker, last week it was announced that february's deficit reached a record $223 billion. the house's continuing resolution simply cuts $100 billion. approximately two weeks' worth of february's deficit and yet the democrats say it's reckless cuts. two weeks of february's deficit that we attempted to reduce. today, i ask my colleagues to join me in voting for this continuing resolution which will once again reduce the federal budget deficit. this time by $6 billion. no, it's not enough, but it is a step in the

mr. scott: thank you. thank you, madam speaker. i thank the gentleman for yielding. i rise in opposition to the rule because it includes a manager's amendment with problematic provisions. the manager's amendment would prevent the disclosure and use of safety data, provides immunity to all persons and organizations involved in the implementation of the safety mesh sure system, and provides total immunity for volunteer pilot and organizations and referring agencies. by preventing the disclosure of safety information, the manager's amendment severely hinders the ability of people injured by the negligence of the aviation industry or their surviving family members from obtaining crucial information that they need in a court of law to determine whether or not their loss was due to the industry's negligence. essentially allows the negligent airline companies and their employees to hide and keep evidence of their negligence secret. additionally by granting immunity to any person that is required to implement a safety measure and program, or system, the volunteer pilots and

mr. scott: thank you, mr. speaker. i thank the gentleman for yielding. mr. speaker, our public schools need more resources and not less. this bill diverts funds that could be used for public schools in the private school vouchers. instead of helping public schools, the bill helps the privileged few who can both win the lottery and have the resources to pay the difference between the voucher and the cost of an education. that cost of education is usually more than just the tuition charged so the recipient not only has to cover the whole tuition but also has to get access to a charity or religious institution which will subsidize the cost of the education. many who win the voucher lottery find they can't even use the voucher because they can't afford the remaining cost of education. and so we've heard a lot about the so-called choice of a private school education. that choice is only available to those who win the voucher lottery. so it's not a choice, it's a chance. and with that same logic we can solve the social security problem by just selling loto tickets

mr. sanchez? >> thank you. scott sanchez, planning department. what we're here for is to see if the board would grant jurisdiction and use the board's ability to reduce the amount of penalties. we assess penalties at up to $250 a day. that can be reduced to no less than $100 a day by this board on appeal. the first enforcement notice was sent on june 15, 2009. the notice of penalty was sent on august 24, 2009. in november 2009 we performed a site visit to remind the property ener about the penalty and they agreed that would file a conditional use authorization. there was a conditional use authorization sup -- submittal scheduled for 2010, but they did not show at the appointment. we later reminded them that penalties were continuing to acue. -- accrue. they scheduled another submittal appointment for january 26. they arrived but didn't bring the conditional use application. we called them in february and reminded them again oar the requirements and the accruing penalties. we did another notice enforcement action in march of 2010 as a reminder. we

that's what our friend from georgia was talking about just a few minutes ago, mr. scott. this now will require a different type of permitting system and it will quite honestly place the burden on farmers, ranchers and anybody who uses pesticides, i assume exterminaters and so forth, it will put a huge burden on them and the only thing that you can do is clearly put a halt to this e.p.a. new regulatory activity. even though the court recently said, well, we won't require this until october, it doesn't matter whether it's required today or whether it's required in october, whenever it is required it's still a burden. so my friends on the ago committee are very, very -- ag committee are very, very serious about challenging the creation of this new regulation. we've been using the congressional review act and we've got several things that we have dealt with on the congressional review act. and what it does, it -- if it is a major regulation -- this is the law today, this law was created in the clinton administration, it's been used once and that's the only time it's ever been

mr. san zphezz >> good evening, scots -- scott sanchez, planning department. this certainly is a good legal issue and discussion. there is a use authorization that does authorization the -- authorize the projects, the renovation of the unit, the parking. the planning commission considers the entire project. the first permit, the 2008 permit, which i believe deals with the parking. the two subsequent permits submitted after the conditional use hearing which deal with the cottage units. you can submit the building permit application after the hearing so. if you don't prevail at the planning commission you haven't spent money on the application. you typically have up to three years to get a building permit application and the board does review those. any did he have vacations we review and we view them to be major deviations, we take it back. in regards to other appeal venues. there was variance for this which was not appealed to this board. variances, even though they're associated with e.u., -- e.u.'s can still be taken to the board of appeals. the environmenta
