mr. simpson and the believability and credibility of mr. er when he testifies. >> and if he is successful in getting a new trial again, we would, you know, relive this entire ordeal, much of what o.j. simpson is telling right now. what would be the chances that he could, i guess, get this entire case overturned and end up free? >> well, it's interesting that the judge is giving mr. simpson an opportunity to tell his story. she certainly could have narrowed the scope of the testimony down. >> right. >> and not given him this opportunity. >> right. >> but she has. and so the defense is taking advantage of that, laying out what they would have done, had mr. simpson had an opportunity to give his side of the story. if he is successful, then, certainly, had will have an opportunity in a new trial. and he will have an opportunity to testify once again. but it's a very difficult and high burden to make as far as establishing ineffective assistance of counsel. and i think it's going to boil down to whether or not mr. galanter should have disclosed h

mr. simpson. today mr. galanter levied a heavy blow against mr. simpson.now anything about the plan to recover the merchandise and when he found outç about it, he advised mr. simpson did not have a legal right to go and recover those items. right now mr. galanter is under heavy fire by mr. simpson's veteran defense lawyer, and under cross-examination, one of those positions that traditionally criminal defense lawyers do not like to be in. >> typically cases like this, how do they typically turn out? >> well, traditionally, they don't turn out well for the defendant. because there is a heavy, heavy burden to establish ineffective assistance of counsel. every individual, every defendant is entitled to good competent representation. they're not necessarily entitled to the best representation. to rise to a level of ineffective assistance of counsel is a heavy burden. in this case, under cross-examination right now, one of the central issues is why mr. galanter didn't challenge the ad missibility of the audio tapes that came into evidence in mr. simpson's matt

mr. simpson claims that it wasn't delivered and he says that it was, i think the court will err on the sidef caution and actually deny his petition. but if there's some other type of evidence that actually lends credence to his argument that he was not given that plea, that's a very, very serious thing. as a defense lawyer, you have to declare all pleas to your client. >> right. just to refresh you, o.j. was convicted of gun forfeitture seizure. he's claiming there was a plea he didn't know about. >> well, he is. in addition, he's saying that his lawyer gave him advice that, apparently, that he could do what obviously he cannot do, because it's illegal, to go in and take what he says is his property, as long as he didn't use physical force or trespass. now, mr. galanter denies that advice. but if, in fact, the judge would believe that bad advice was given, than mr. galanter would have a conflict in representing him. he would have a conflict in whether to testify or not at the trial because that might affect the attorney's reputation if he gave that advice. and that is very serious. so the i
