mr. martinez's neck.d marks, tom, is there anything you know of that could be in the van, could be used as part of restraints that would cause these? >> no. >> no, okay. >> i don't know of anything -- there's no way the police are going to put something around his neck in the back of that van. and from what you see in here, there was no indication of a need. he's standing calmly as they open the door and get ready to have him get in the van. so you don't see that. and if the police were trying to hang him in the back of that van, it would be pretty hard for the other prisoners to not be aware that something's going on, that he's being handled in a way that would be extraordinary, let's say, compared to a normal ride to the jail. >> yeah, and the sheriff said he did not have those marks while he was in the custody of his department. at least in that van. at least until the time of his death, was in their custody. tom fuentes, thank you for joining us this morning to talk about this. >> thank you, victor. >

mr. martinez that shows that there was some preexisting condition that led to his death after being in thatre was no preexisting issues. when he was in the courthouse, dealing with going back to jail, he had no marks on his neck, according to his mother and other people that had seen him. from the point of where he goes to jail and goes into court is where we have the issues. there's a minute and ten seconds of the video where he goes to step into the van and the video freezes for some reason, even though they say that it's motion detected. from that minute and ten seconds, then there's another eight minutes that we deal with the inmates, for them transporting them to the jail. then we have another five minutes from wherever they unload them. so there's a lot of time that's in between this and there's a lot of time where it shows that these police officers had direct contact. i feel that the sheriff has stated that, you know, the investigation is still ongoing. but he seems to have already clered all his deputies. he seemed to have cleared everybody else in the room except for the inmates a
