an official at the stevens county district attorneys office told msnbc. we learned the three assailants after the cold-blooded murder went out looking for their next victim, according to this man, their son, a black teenager in the school threatened by the boys and called his dad panicked about it. of course, mistakes happen in reporting stories all the time. this is one of those revealing mistakes that shows how much fox & company want to use this horrible murder as a means of pushing a certain story line. the whole thing was so reverse engineered and overdetermined they couldn't bother to wait and check the facts. the irony here is that it is the right constantly accusing us on the left of making everything about race, turning every action and event in america into a product of the grievance industry, whatever that means. in 2009, fbi data shows 209 black people were killed by white people in instances where we know the race of both the victim and offender. it's not like every one of the violent crimes is a major story in the progressive media or any of

let's bring in msnbc contributor and former bush/cheney adviceor, robert trainer.angela, what do you make of summer's possibilities here? janet yellin is vice chair of the fed. >> a number of things. one is we can't just skip a president and go back to president clinton's 13. there was a president in between. there was george bush's eight. i think the other thing we have to really pay attention to here, richard, is the fact that the president has also made monumental strides of appointments of judges. the only two supreme court nominations he's had, he has apied two women. i think it's terribly unfortunate for us to look at isolated incidents rather than the total picture. >> if he not to pick yellin and goes with summers, you're fine with that? >> i don't have a personal opinion about who he picks. i think it's most important that he picks a person that works well with the overall obama administration and does their very best to advance policies that not only impact the overall american public, but also people of color and women. so whoever is best suited for that

catch his town hall here on msnbc at 12:45 today. remember we are hours away from the expected resignation of san diego mayor bob filner who could step down by the end of business today after more than a dozen people women reported being sexually harassed by the mayor and prompting a lawsuit and joe fryer has been covering the story for us from the beginning. live now in san diego. joe, what can we expect today and when can we expect it? >> reporter: really this resignation is likely contingent on a tentative deal that was reached earlier this week in mediation. the city council is supposed to meet behind closed doors this afternoon at 4:00 eastern time, 1:00 here west coast time, to discuss and perhaps vote on the deal that was reached. all signs indicate that filner's resignation is part of that deal. the big question is what might the mayor be getting in return? does it involve the city agreeing to help out financially with either legal costs or future settlements? if that is the case, how is that going to sit with the city counci

and msnbc's joy reid. could you tell us what the nypd's rationale is for stop-and-frisk and what is left of it now after this federal court ruling? >> well, certainly, their rationale behind this case really is they feel it is bringing down crime. that is the key to the entire thing is stopping violence. but unfortunately, their position on this is totally misguided. they're completely wrong, and all the statistics indicate they're wrong on this, and why they continue to push this is just untenable. there is just no reason for them to continue. in 2002, when police commissioner kelly came into office, crime was already down 63%. so to claim that somehow a 600% increase in stop-and-frisk is causing a crime decrease is just lunacy. it is just completely wrong. >> and john, the nypd became a statistics-driven department over the last several years on everything. and under bill bratten, had he was running it. and can you explain to me why these statistics don't impress them the way they impressed the judge, wh
