ari melber is msnbc's chief legal expert. so ari, first of all, from a purely legal standpoint, would it even be possible to ban all muslims from entering the united states? >> no, erica. it would be illegal and unconstitutional. donald trump doesn't seem to care about that, which i think is important and also revealing. but basically, there are some lowered protections for non-citizens in certain constitutional areas. for example, search and seizure. you have more protection as an american citizen than as a non-citizen. but in this area, the law is established and clear, the government can't just make decisions based on suspect or inappropriate classes, like race or religion, even as it pertains to non-citizens, even if they are not ever going to come in the country. of course, immigration works by making those decisions. now, did donald trump consult his campaign lawyers? did he put out a practical plan? did he look at any of those precedents, you heard him mention on the fly, fdr, no. it was just a couple of paragraphs. an

msnbc's cal perry has been looking into that.we know at this school today, this is the first anniversary of that massacre that falls on a school day at the elementary school. they were not having a moment of silence for obvious reasons. small children there at the middle school and high school a moment of silence. but we are looking at the totality of it and the impact that the conversation had on the gun debate after newtown. >> yeah. and the way that you talk about this with kids is obviously so important. let me show you nationally gun violence against -- these are kids 12 and under that we're taking a look at since the newtown shooting. 554 kids have died since newtown in gun violence here in america. as we go sort of state by state you can see some of the states per capita where we are seeing kids get killed. louisiana has had some tough statistics in the last three years, as well as montana. i waited for this data to come in last night. one thing that surprised me -- almost 60% ever kids are actually getting killed in homic

msnbc chief legal correspondent ari melbourne is back with us. terms here. no indictment. what should we make of this? >> you have three layers here, the traffic stop, which was controversial, her death, which is what the questions are about, and the process of investigating that. you look at video of the traffic stop as you just reported, changing lanes, turns into this massive altercation in bringing her in. people thought it was excessive force and not handled the best way. in the jail, she's found dead and they say it is a hanging, they say it is suicide. it was ruled a suicide. so then the next question, the third layer we have the news on is this was presented to the grand jury, didn't return any indictments relating to the death. that means at a legal level the grand jurors did not see enough here to charge a crime. they don't think either it was a crime they don't think people killed her or don't think that they know enough to know who killed her and moved forward with the certainty that it required on that. i will tell you what is messed

i want to bring in a director with flashpoint and msnbc terror analyst.nse as you look back on 2015, how has the global terror threat changed? >> the threat landscape really, really transformed in the last year and a half or so. the united states has 65-plus nation coalition that is engaged militarily in the middle east. that is after we withdrew from iraq in 2011. you have a terrorist group that is not only launching attacks but has dominated large swaths of territory in the middle east and north africa and is expanding beyond the region and areas we can't target in afghanistan, pakistan, nigeria, even bangladesh and the philippines. so we're seeing isis tentacles reaching. but we look at isis as a centralized threat. but there is that decentralized threat that emanates from its ideology, self-radicalized individuals at home, especially in the post-san bernardino attacks that rose up and that's a big challenge. >> so when you look at the way that this has changed, we know of more than 900 different investigations going on across all 50 states by the fbi,

msnbc's steve kornacki is standing by. people can make assumptions about who his supporters are but you have the data. behind it. >> yeah, some surprising data here. first, just remind you exactly where he stands right now. this is the latest out of new hampshire. this came out last night. this isn't going to measure any effect from this latest controversy but you have donald trump there more than doubling up his nearest rival, marco rubio. you also have in iowa a little bit of a different story. he has fallen behind, trump has, in one poll to ted cruz, leads in two others recently. key thing to keep in mind there though is cruz is the one republican candidate who really isn't attacking donald trump, really isn't criticizing donald trump. cruz is doing well with voters in a lot of cases who also like donald trump. in terms of who these trump supporters are, this is probably the most important divide to look at within the republican party. the college, non-college divide. this splits the republican party in half. half of re

msnbc investigative reporter and former l.a. times reporter. i know you're learning much more about just, you know, these suspects, how armored they were when they walked into the inland regional center. there's a number of things that we can and cannot confirm at this hour. can you expand on that? >> well, i think the biggest thing we know is that there were two suspects. obviously, you had heard earlier there were potentially three shooters. this is typical for a chaotic scene like this, where you have, you know, 14 dead and 17 wounded. and you have to process a crime scene. have you to look for suspects based on descriptions. and then as the hours wear on and then they can kind of hone the information, then as we seem -- it would appear there was this couple involved in this shooting. what we'll see going forward, it started tonight and will continue to go forward into the days and weeks, perhaps, to come, is really trying to establish a motive for this. so, was it a workplace grudge, was it something else connected to, you know -- obviously

let's go live to msnbc's richard lui.de of the hospital where some of the injured are being treated. what's the latest there? >> reporter: good morning to you, jose. you were just showing some of the pictures coming from some of the helicopters. as the sun rises here in southern california, there is that primary story of the investigation, but there's also a couple of other layers. first off, there is now this small town of san bernardino city trying to get back to work. you can probably hear some of the activity here around where i'm at. they are building a brand-new parking structure to my left. we can see helicopters in the sky. and at the hospital behind me, the bridge that attaches to one of the other parking structures, now people crossing, coming to work. it is a new day here. and as you've seen before, that day after is when the citizens and the residents of these communities try to get back to work. and they are now doing that because, for instance, at the local universities, now open. but the third layer of this
