president murphy: thank you. next speaker, please. >> my name is tom. i'm with the housing rights committee of san francisco. i will try not to be repetitive. maybe some things are worth repeating. i would like to sor second to before collaborative said. their recommendations are excellent. we see the same types of situations. landlords do not respond. tenants are asked to do things that violate their civil rights. i would also like to repeat what someone said about alternative treatments. we see a lot of people with asthma and other types of diseases. these chemicals are extremely toxic. there are some alternatives. i think there's more work that could go into that. those things are of a horribly affected with bedbugs. in terms of the numbers people are siding, i would say those are very underestimated. those are the tip of the iceberg. a lot of people do not report bedbugs. a lot of tenants just leave their rooms. what we're looking at is an epidemic where we do not have any good idea of how many cases we are d

commissioner murphy: i would agree with commissioner hechanova. i think ms. fong did everything right and she is getting slapped on the wrist here -- at least that is the intenst. at the time, too bad for the owner -- i do not particularly like that. i am sure there was some staff time spent on this. maybe too much time. that is not for me to say. that is just my humble opinion. commissioner lee: i think that this is unfortunate that this situation rises but i do not think our department did anything wrong. completely waving the fee would be admitting that we did something wrong. maybe there could be a compromise, maybe a midpoint? how about 50% of what the fee was and then suggest that the owner seek remediation or something with the previous owner? >> i do not believe the owner will have a chance to get the money from the bank. we are charging this fine to her when she did nothing wrong. i am wholly opposed to that. commissioner walker: i think this is setting a bad precedent. is basically allowing banks to do what they want to do. ultimately, it is the ban

commissioner murphy: looking at this, the way i see it, the rules were written in december 2009. at that time, the bank of new york own the property. there was no compliance and the case was scheduled for the directors hearing. the notification at that time went to bank of new york. between the time of the notification and the hearing, title was taken to the property. nobody showed up. the order was then issued. in march, the order of abatement was mailed to the bank of new york. the owner claims that mail should have gone to her and not the bank of new york. she made repairs, is that true? >> yes. the invoice and reinspection took place. it was repaired within less than 10 days. commissioner murphy: so she made the repairs as soon as she was aware of them and then mailed it to the housing inspector in july. for some reason, the inspector did not verify those repairs until october. commissioner lee: i think you just made your case that the board of abatement went to the wrong party. commissioner murphy: yes, so i see the present owner -- commissioner walker: and that is what we a

commissioner murphy: thank you. any further questions? >> i'm not done. each one of us, i think, has our own ideas about what form these seismic safety efforts should take. you step back, and you realize we're all pulling 90% in the same directions. certainly had some mild disagreement with jason and perhaps with each of you in terms of what direction this should all go. it is exciting how much we have gotten done, and we will all make sure that this does not sit on the shelf, that we get action implemented that we do not get stuck in more committees and reports and what have you down the line. the capss initiative has moved on to amy brown. there are -- i will make a mild disagreement with you, director, in terms of i think there are these three or four things that we have asked webic to do -- asked the bic to do that rightly remain with the building inspection commission. these are as i see it, some black and white building issues that are technical in nature. there were four recommendations we recommended. first was to enact the post- earthquake repair
