commissioner murphy: commissioner lee. commissioner lee: i am glad we are talking to other departments. i am hoping it goes smoothly. it is good to hear that everyone else is on board, but two years out seems a long time. technology moves very fast. apple turns out an ipad every 10 months. if we are working toward a two- year goal, is technology going to change, are we going to be keeping pace with the latest developments? those are some of the question that we need to ask. the best thing would be to get this out quicker. >> we have been carefully looking at what versions people have been able to acquire when they do this type of project. the companies are typically trying to make sure that whatever the latest version is there. primarily, the reason this project takes a long time is, -- i do not want to say customization, because it is not. it is a way of modeling to make sure that things are set up in the way that we need them to be. an off-the-shelf system is basically a structure. this is simple terms. i would think of

president murphy: commissioners. president o'brien: if there is no questions from any of the commissioners, just so everybody understands, we had hoped to have, as the gentleman said, mr. sider said, three-way commission hearing and we didn't realize or reoverlooked the fact that the planning commission meets on a weekly basis which is more than these two commissions meet and so time is more of an issue for them. so we decided we should go ahead with this meeting because we have other issues to discuss as well as just getting a baseline on discovery of what we might talk about in the future with the planning commission. i would definitely like to ask some questions if i may that would help drive things forward the next time. there are lots of people in the development community who will always first and foremost try to get what is referred to as an environmental exemption. it makes a big difference for those of you that may not be familiar with the process because if the project becomes subject to the environmental -

commissioner murphy: we appreciate it. welcome. >> in your package under item threed, we have included our requisition tracking list. we gave this to the commission is for the first time. this shows the date we put the requisition and, where it is going through the department, and eventually, if the commissioners would like, we could do a flow chart on how the requisition process works in the city. it is quite involved, like the contract administration. as you can see, we have been unable to fill several positions, due to the fact that there are no current lists that exist. a lot of the employees we are bringing back are coming back in temporary positions or limited duration positions, until these lists can be created by dhr. we have several of our requisitioned that are being treated as we talk about. the mechanical engineer list just came out two weeks ago. we are waiting for the referrals to come from dhr on that. we will be able to fill our full-time mechanical engineer list. that is one good thing that will happen in

president murphy: public comments, please. commissioner romero: this has come up at past meetings, communication having to go across the d.b.i. and planning department. i really would say the question you really have to direct that to, you have to direct it to the mayor's office. realistically, you have two departments, and if they're not talking to each other, my understanding is that planning and d.b.i. have meetings every week or every couple weeks, management meetings. and if they're not talking to each other there, then there is a problem. but i completely agree. i think it would be best for d.b.i. if there was a better communication between the two, but i don't think that's something that we can force unless the mayor's office is willing to do that. president murphy: are you saying we have two dysfunctional families here? commissioner romero: no, i didn't say that at all. commissioner walker: i think as we talk about the permit tracking system and that we are working together with planning and the other departments, i th

president murphy: commissioner riley? commissioner riley: as you know, we only hear about experience. it can take months or years to get the permit done. and i know that every situation is different. but let's say in case of a perfect situation, how long should a small business owner -- can expect to get all of this done? >> is the small business order filing appeal? are you talking about the process ifer the review and approval of the planning commission? >> well, both. maybe mr. cider can answer it as well. >> i think maybe it's something that he can add to the list for that joint meeting that you guys are having. as that list keeps growing. but as far as -- there are specific deadlines on when we actually have to schedule the appeals before the boozer once -- with the board of supervisors. there's a little bit of an allowance. there's 45 days. and they could be continued if the project sponsor and the appellant are all in agreement that, yeah, we're going to continue these items, it still is up to the board. and from a

president murphy: questions? seeing none. >> i just wanted to respond to the commissioner about making a list about what businesses are fully compliant. i think one of the unique issues with this particular item is that, for an example, with parking lots and the striping, they just changed the color. i think it just went from blue to white. if you did not update your parking lot, now you are out of compliance. i think the idea is a really great suggestion. if it is a program you can implement or it is a certain time that businesses get an acknowledgement -- but then they have to revisit because of ongoing changes in code that businesses are going to be required to stay up with. commissioner lee: i have a question about obligation. does the landlord and the tenant sure the obligation, or is it just the tenant or the landlord? >> the landlord and tenant share the obligation. most landlords put it in their commercial leases that all 88 or accessibility requirements are required to be done by the tenant. that is gene
