ben gellis, the naacp.l framework and we talk about the moral framework the coalition built in virginia through a lot of hard work and organizing of different constituencies to get this felon disenfranchisement policy changed. are you having success getting people from across the aisle to join in this or is this just a liberal movement at this point? >> well, the current legislature is so extreme, but in the streets we are, because what we've done over the last few years, we built a coalition, rooted in the notion of the common good and rooted in the moral principles of how do you treat the least of these. you know, if you look at the scriptures, more is said about how we treat the poor than any other subject. we've seen blacks and whites and labor and people of faith and civil rights come together. we have 147 organizations along with 100 branches of naacp and we're taking a comprehensive view. we have to change the way in which we approach public policy. there's some things that are bigger than democrat a

a friend of the show, former naacp chairman said the scrutiny of the tea party was justified. i want to talk to you about what he said. >> i think it's entire legit to look at the tea party. look at the group of people who are admittedly racist, overtly political, who try the best they can to harm president obama in every way they can. >> michael: you know, if these are not social reform groups and they have a political agenda, what were you were just saying saying about the gun shyness of the irs doesn't this hurt us as a country when these groups are not investigated in this way? >> it makes a mockery of the law. it allows groups to hide their donors and really hide in the shadows while trying to influence politics. i'm not going to paint every tea party group out there with the same brush and say that they're all trying to put a fast one by the irs but as this former irs director, who i talked to today. this is a guy for a decade ran the division that oversees these groups. he said people try to put a fast one over the irs every day. and it's the irs's job and people expect

you used to have a specific target at the 501(c)3 that the irs takes, they look at the naacp or recently republican congress person complained about the humane society, complained to lois lerner that took the fifth today, why aren't you looking closer at the humane society abuse of c 3. it is so comical that 501(c)3s understand the irs is stricter about c 3. so what do most c 3s do when they want to get involved in political activity? form a 501(c)4, so you have all of these convoluted organizations, super pac with a c 4 or c 3 with a c 4. they do it knowing the irs is going to misinterpret the law, allow them to do political activity through the c 4. that's why karl rove who has never done a day of social welfare i could ever interpret or find has a c 4. doesn't even have to pretend. i totally agree with you. the scandal is that the irs overinterprets c 3, goes after charitable organizations if they have a hint of disagreement with the president, naacp, but they let anybody slide through c 4. you've got members of congress declaring an inalienable right to be a tax exempt organization.

the naacp released a letter they'd been sent by the irs.he quote from it singled out by "politico" who remembered the story and connected it. quote, we have received information that during your '04 convention in philadelphia, your organization distributed statements in opposition of george w. bush for the office of presidency. whether or not that irs letter was properly sent to the naacp, the impression that the irs would in an election year go after the president's critics, that is a powerful impression. that same year, the irs wrote to a liberal church in southern california whose pastor invited a guest to give an anti-war sermon, an anti-iraq war sermon. the irs heard about that and responded by threatening to take away the church's tax exempt status on the basis of the content of the sermon. the church's local congressman, democrat adam schiff ended up meeting with the commissioner of the irs to express his concerns about that when that happened back after the '04 election. so the inspector general's report on what's going on with the
