nadler: well. we have been -- all right, we have been engaged in accommodation processes with the justice department and various other witnesses to get testimony and to get documents and so forth. it has been largely fruitless. but it was necessary to do that if you're going to go into court to enforce your subpoenas. which we're doing. with respect to 6-e, grand jury testimony, we have not requested previously, you have to go to court and request it. in previous cases, the special prosecutor, i'm sorry, the committee went into court and requested this, 20 years ago, 40 years ago, and the attorney general went into court and supported the application. this time, we're going into court today, i don't expect the attorney general to support the application, he may oppose it. but we want -- we have to see the underlying grand jury material. there are a lot of things about the mueller report which will be very informative to us. reporter: but doesn't it set a dangerous precedent if it gets leaked out? w

nadler: good afternoon. i am joined today by many of my colleagues from the house judiciary committee. we want to say a few words about director mueller, what we learned from his testimony and next steps in our work to hold president trump accountable for his conduct. robert mueller is a man of honor and integrity. he has led a life defined by service to his country. some have argued that because director mueller was reluctant to testify and seemed older than some remembered him his work is somehow diminished. it is not. before he ever stepped into our hearing room, the director had rendered our country a great and necessary public service. he showed through his report and his indictments that the united states was attacked and remains under siege by a foreign adversary. he showed that the trump campaign both welcomed and benefited from this attack on our country. and he showed that the president repeat think lied to cover it up. if that were not enough, director mueller's testimony removed all doubt. he tol

>> there's a big division between pelosi and nadler. and nadler has said he wants to push forward. i think pelosi is much more cautious. she says we need to wait and see how these investigations play out. i think there's a difference obviously between starting the case for impeachment starting the investigation which apparently nadler has already done. and i think that's really where pelosi is trying to avoid. because the vast majority of americans don't support impeachment at this moment and she's trying to protect her moderate members who have to be re-elected next year. she wants to keep her majority. even though there are almost a hundred members of her caucus who do support impeachment, there are 140 that don't. and they still want to wait and see what happens with these other 17 investigations into the president before they make this case. >> and yet the time as we've been discussing, the time is ticking because 2020 is right around the corner. good to have both of you with us. thank you. >>> congressman elijah cummings is speaking up and standing up against a twitter attack

and then you have nadler saying i'm kind of doing impeachment already. what do you think about that? >> he made it clear that's under consideration. p it adoesn't mean there will b an impeachment trial on monday. we heard speaker pelosi be a lot more cautious and judicious in her approach to this, and this is her word, the democrats needed to be sophisticated how they approached this. they want to have the best hand possible if and when they move forward with paecimpeachment proceedings. she means gathering more evidence, having more hearings as don mcgahn, the former white house counsel, who nadler's committee is trying to bring forward for public testimony, that remains under negotiation. but that would be a big moment for the democrats potentially. but there are a lot of steps here still to come. >> it kimberly atkins, i want to ask you a question after i play a little bit of nancy pelosi here. pelosi's getting accused by a variety of people of slow-walking impeachment. she doesn't want to do it but she has to make the base believe she's kind of open

i want to zero in real quick on something that jerry nadler said in the clip you played there.mentioned the president lied to investigators that was really the only real new piece of information that came out and asked by congresswoman by the president's responses, written responses to investigators, of course, in the 448 pages, mueller wrote that he believed that the president's responses were, quote, incomplete and inadequate but mueller went a step further than asked when asked by congresswoman, do you believe the president -- the president's responses were also untruthful and he said, generally, yes, that was a new piece of information that we had not learned from the mueller report itself and that's something that jerry nadler was trying to focus on there. >> yeah, hasn't been highlighted a lot in the coverage. on the other side republicans are going after alleged fisa abuse, questioning how the whole thing started, was it a total set-up. >> nothing more, nothing less than a cover-up, okay, you know, why would you not -- you write a whole report, you mentioned 65 times in

so how can nadler force him to testify? >> well, and that's one of the bogus arguments that i'm talking about. i think they have a much stronger argument, the house, as to forcing don mcgahn to testify than they do on the grand jury. grand jury material is, and frankly, not that important. >> you don't think it's that important? >> the grand jury material. there aren't that many portions -- it's hard for me to say. i haven't seen it. maybe there's a golden piece, but there aren't that many pieces that are redacted a to grand jury. it doesn't mean it's not a battle worth fighting, but the don mcgahn argument, that's one that i think a court would quickly say to the trump administration, you are making way too broad of an argument. again, though, i think that having the official impeachment word invoked, the impeachment inquiry, would again, help in fighting back against these arguments. >> you think that the question of don mcgahn is worth going to the mat over? >> absolutely. that would be, you know, we all said, a lot of u

the white house obviously watching this, the jerry nadler briefing. he's probably going to talk about don mcgahn and the legal steps to get mcgahn, a reluctant witness. >> reporter: house democrats are going to get access of the grand jury material. they also intend to go to the courts to reaffirm their oversight authority and responsibilities, really, to get don mcgahn the former white house counsel who was a key player in the mueller proceed to testify before that committee. this is part of the process that nancy pelosi says she wants to see play out before house democrats move or potentially move towards impeachment. again, today, we heard her reiterate she's not against starting impeachment proceedings against this president, she's just not for it right now. she wants democrats to be able to be in the best position to make the best legal argument as she puts it. right now she sees that process as playing out through the courts. there have been those progressive whose have accused her of trying to run out the clock. the clinton impeachment was a fi

we're waiting to hear from the chair of the house judiciary committee, jerry nadler. the house is out today, they're out through the august recess and back in early september. we expect to hear from chairman nadler about this week's judiciary hearing with former special counsel robert mueller. should get under way shortly. >> the time frame, tried to ask how long it takes, not be ndless, would not say there. but in a matter of moments we'll hear from chairman nadler. >> i think you guys are early. > you flying solo?
