. >> good evening i'm denise nakano. it is a unique case that stretched across montgomery county today. kathleen kane was with her legal team in norris town while a judge watched it all on a tv screen in collegeville. tonight, we have nbc 10 live team coverage offed to's developments. we begin with rand y gyllenhaal >> a quick proceeding. a few minutes long and the first step in what could be a very long criminal trial against pennsylvania's top law enforcement official. >> attorney general kathleen kane walk under to the detective's bureau in norris town and flanked by photographers she had no comment. kane was immediately processed and fingerprinted. her mugshot was taken and then led to a video camera to face a judge. seven miles away in collegeville, judge kathleen rebarr walked into her courtroom and kane was read her charges but the public was not able to see any of this because the judge tilted the video monitor away from the media. you could only hear the proceeding. >> i went to the grand jury. >> reporter: penn

i'm denise nakano. we have new information about another story out of california that you're likely to hear a lot about tomorrow. a banner plane crashed in compton, colorado. the pilot died. it was reportedly carrying an eagle fan banner scheduled to fly over the practice near the crash site. we have not been able to confirm it was actually an eagles fan banner. witnesses told the l.a. times it was a bud light banner. a tweet from a local dj saying he hired the plane started the talk about the eagles banner. a statement from the dj, it is still to be determined whether or not the plane involved in the accident was the same plane contracted for the flight over oxnard, or if the accident prevented our flight from happening. the faa is investigating but won't say what was on the banner. we're working to reach more witnesses tonight. >>> tonight, we are counting down to the pope's visit to philadelphia. he'll touch down in the city in 47 days, on saturday, september 26th. it's not just the city of philadelp

i'm denise nakano. rafael should have been celebrating his daughter's 10th birthday today. instead, his family and fellow officers are in mourning. the accident happened before midnight at henry avenue and dupont street. randy gyllenhaal is live on henry avenue. some compared this area to a racetrack. >> reporter: denise, part of the problem is, especially at night, this road, henry avenue, can feel almost like a highway. the lanes are extremely wide. however, when you approach some of the curves, the speed limit is only about 30 miles per hour. residents have been reporting a lot of accidents, including the tragic one that happened last night. the off-duty officer's truck crumbled when it slammed into a tree. he missed the curve. police say he was speeding. rafael, a 10-year veteran of the police force, died shortly after impact. >> a beautiful guy. that's all i can say. >> reporter: his friends say he leaves behind two kids. his daughter just turned 10 years old day. >> loved his children. all playing. >> he will be dearly missed at the 39th district of the philadelphia p
