not necessarily fallen, no. >> nancy grace following the trial for us. said based upon the way she was lying there, it didn't look like she had fallen. what is your take? >> well, here's the way i see it. practically every wince htness had a different view or a different rendition of what they saw when they went into that bathroom. here's the significance. what matters the most to me is what the little girl, 6-year-old she says her mother was lying in red water fully clothed, face up, eyes open with her hair going back down the drain. macneill says he came in following ada when she was slumped over the side of the tub as if you would slump over to wash your hair under the faucet. the neighbors see her, the water has been drained and she's still in the tub. here's my question. why did he lie on the 911 call? there's no way he could have performed cpr with her in water in the bottom of that tub. it's a very high tub, the kind you crawl into. you know for cpr somebody's got to be lying flat on the floor. so why did he lie that he was doing cpr? he didn't ev

dan abrams and nancy grace will weigh in on this in a moment. reporter: david will be in a courtroom this morning, defending himself on murder charges for the third time. the former indiana state trooper is charged with the shooting death of his wife, their 7-year-old son and 5-year-old daughter in their car back in 2000. a crime he's consistently denied from his first interrogation, 13 years ago. >> i didn't do it. i didn't do it. >> reporter: he has been convicted twice. both times he has appealed. and both times the convictions have been overturned on the grounds the court allowed inadmissible evidence about his alleged affairs, along with accusations he molested his daughter. each time, he's been charged again. in an interview with wlky, he says he dreams about his family every night. >> it's a double-nightmare. i'm here for something i didn't do. >> reporter: in 2005, the dna on a sweatshirt found at the crime scene, was tied to convicted burglar charles bonet. he's been sentenced to 225 years for the deaths. camm's lawyers say that evidenc

provo, utah, where she will be covering the trial tonight and every other night on her show, is in nancy grace me, dan abrams. nancy, this case took years to come to court. the two daughters, the two older sisters, really pushing police for a long, long time. they believed from the very start that their father was guilty of murder. will this be a tough case to make? >> well, i think that there are a lot of obstacles for the state. and the biggest obstacle for the prosecution is that the original medical examiner who has now sadly passed away by breast cancer, ruled the death natural causes. she was not privy to the facts surrounding the case as we are. when it was opened up, reopened and other medical examiners looked at it, other medical examiners believed it was not natural causes. medical examiners now believe that she was drowned in the bathtub. the defense has just come out with their defense is going to be alibi. and i've got a lot of problems with dr. macneill's so-called alibi. >> well, dr. macneill has credibility problems. he's a conman. he has a long history of swindling money from
