open this up to judge andrew napolitano. here we are noon hour eastern time on monday before the election. eight days out, judge. give us an idea what it looks like inside of the fbi now. they have this warrant to go over thousands of emails, what are they doing right now? >> so i spent the weekend and as did catherine, some of our colleagues receive information variety of law enforcement and intelligence community sources. when that information is corroborated with, we go with it but when it contradicts we investigate further. i have a pretty good idea as does catherine whose work is superb as you know, i have a pretty good idea what is going on. the search warrant authorizing the fbi to get into and actually read emails was not signed until last night. the application to induce the judge to sign the search warrant did not mention hillary clinton t mentioned huma abedin. so the way for them to get into the laptop beyond anthony weiner's emails, he gave them the laptop, consented to them reading his textings and other things

judge andrew napolitano is here on this subject. all right. it sounds very serious.elony corruption, is it? >> yes, yes, well, it is serious. one version of this is that mr. kennedy was and still is the deputy secretary of state. this happens two years after hillary leaves office under john kerry's watch as secretary of state. asked the fbi to change classified markings on documents. the changes happen all t the difference between top secret and secret is grave damage to national security if released or serious damage. what's the difference between the two. it's subjective. so often the markings are changed so that more people can read the document, but markings are never ever, ever changed after the document has been subpoenaed, after it's in fbi custody, and once it's been accumulated for a criminal investigation because to change a marking then would constitute obstruction of justice, tampering with evidence, and if there is a kid pro quo, i'll give you this tie if you give me that tie, that would never happen here, but if they were doing that then there's an offe

now, to judge napolitano to hear what he has. that's serious stuff. >> it is serious stuff. i respect the sources upon which catherine is relying. it's not uncommon for the cia, the fbi, the state department to negotiate about the difference between, say, top secret and secret. it is not uncommon for a classification to be changed by consent in order to broaden the array of people who can see it if they must see it and they lack the classified clearance fort higher marking, but it is absolutely unheard of to change the marking on a document after it's been subpoenaed and when it's been collected in a criminal investigation. any alteration at that point, neil, becomes either obstruction of justice or tampering with evidence or if something is offered in return for the agreement to change the marking, an attempted bribe. so catherine is quite correct. the fbi eatings who are very unhappy about this and feel their hands were tied are justly angry. there's a serious problem here with the rule of law. it tells me that someone somewhere told the fbi from day one do not prosecute a
