now next week, nathan hochman becomes the district attorney. he's a different district attorney. he's going to be then gascon because he campaigned on tough sentencing. smart sentencing, but fair sentencing he says that he hasn't even begun to look at the record yet. but this one is based on rehabilitation which california law has focused on, saying that both of these brothers have really participated in programs inside the prison first of all, lyle menendez, he has gotten his bachelor's degree from the university of california irvine. while he's been in prison he's created programs inside the prison rehabilitation through beautification adverse childhood experience to help counsel and talk with other inmates, and then also the juvenile life without parole because he can understand that better than anyone. to counsel those that are sentenced to life without parole now, eric, he got his associate's degree. he actually learned and got a certificate in sign language to help those that are profoundly deaf in prison. he created other programs victim impact, victim sympathy for vulnera

joining me now, la district attorney elect nathan hochman joins us now.elect, thank you for being here. you know many of the details of the menendez case, of course, are well known to you and, frankly, to the public. more broadly. but what will you be looking for in evaluating their >> so in order to evaluate a resentencing and by the way, the resentencing is one of three different tracks that the menendez's are currently on. there is a habeas track. and you mentioned about it, but it was actually filed in may pending ever since then. and that's dealing with the new evidence. the second track is that clemency track. and governor newsom, since he came into office in 2017, up until today or tomorrow, could grant clemency. and that's the second track. the third track is resentencing and george gascon actually had that motion in february of 2024. but he waited until 12 days before the election when he was 30 points down. and finally announce his resentencing forward on resentencing and recommend from go from life without the possibility of parole to 50 years

now, it's really up to incoming district attorney nathan hochman.s public statements during the election he didn't take a position one way or another, nor has he since he's been district attorney-elect. so tomorrow's status hearing is going to be really important. and the question is, are prosecutors going to detail what hochman intends to do, because i think that's the key piece of evidence. the resentencing isn't until december 11th, and hochman takes office on december 2nd. brian: they're doing a lottery system to give out tickets to watch this remote appearance by the menendez brothers. i mean, does that surprise you, that it's become such a spectacle? >> it doesn't. this is my hometown of los angeles, and this is probably the biggest case here since o.j. simpson. there's a lot of support for erik and lyle being released. people want to be in that courtroom. there's only 16 seats available to the public and 2 standby seats, so there's going to be a long line outside that courthouse tomorrow morning. brian: it's unbelievable stuff. great analysis
