robert honda, nbc, bay area news. new information tonight on the rape case involving the former san francisco 49ers dana stubblefield. he will have to spend at least another two weeks in jail. an appeals court overturned stubblefield's conviction last week. it determined prosecutors made racially discriminatory statements about him being black, and since then, the department of corrections moved stubblefield from corcoran state prison, which is 160 miles south of the bay area, to elmwood jail in milpitas. now, this morning, stubblefield's attorneys returned to santa clara county superior court, but the motion to release stubblefield was continued to january 17th. the court says it needs more time to review the motion and see who has jurisdiction. the judge was very sympathetic about our situation, and he recognizes that under law, he should be returned to the status that he had prior to this false conviction. stubblefield's attorneys say their first priority is to get stubblefield released. then they plan to ask the j

here's nbc bay area's cyd ho quintana. as crews set up for the first downtown first thursday of the year, organizers are hoping for the same turnout or even bigger than past events. but this one comes just one day after a man drove into a crowd down bourbon street in new orleans, in what authorits say is a deadly terrorist incident. organizers of downtown first thursday would not discuss specifics of their security plan for tonight, but did send us a statement saying, as with every downtown first thursday, we coordinate all of our security and public safety plans with the san francisco police department. according to the sfpd, they will be fully staffed for all of the major events in the city today and in the future. that includes the warriors game and the downtown first thursday event. today, mayor elect daniel lurie announced the appointment of a chief of public safety. it's a new position in the city administration. the new appointee says coordinating the city's response to big events will be a key part of his job. we n

nbc's chris pollone joins me from d.c. hi, chris, good morning. the president-elect tried up until the last minute to stop today's sentencing. >> reporter: hi, frances, good morning. that's absolutely right. president trump's lawyers asked the supreme court to intervene. but, in a 5-4 ruling, the court decided not to step in. the court said the sentencing should not be much of a burden to the president-elect. the new york judge has made it clear that the sentencing will not include any prison time. the court said he could address any issues he has with the case through appeals. and last night he said that's exactly what he will do. >> well, they called for an appeal. and, as you know, they acknowledge what the judge said about no penalty, there's no penalty. but we're going to appeal anyway, just psychologically, because frankly, it's a disgrace. >> reporter: a source with knowledge of the proceedings told nbc newews what we can expt today. they say both the prosecution and defense will be given a chance to speak if they want to. president-elect t

jodi hernandez, nbc, bay area news. let's take you to san francisco, where doctor jill biden made what may end up being one of her final public speeches as first lady. she arrived last night at sfo for a three day visit. this afternoon, she spoke at the jp morgan healthcare conference at the west saint at the saint francis. in her speech, mrs. biden discussed the importance of advancing women's health research and innovation. she is expected to attend that conference tomorrow as well. another school district is considering shutting down schools to balance the budget. that includes the franklin-mckinley school district in san jose, but one of the schools on the chopping block is named after captain jason dahl, one of the heroic pilots of nine over 11. and that has added a new level of anger and frustration to the discussion. here's nbc bay area's damian trujillo. parents will hold a huge rally here before school. they say they understand the need to close some schools, but they argue this is not the one. a captain's hat

nbc bay area news.l, she just left congress last week, but barbara lee isn't done with politics. apparently, the former congresswoman announced today that she is officially running for mayor of oakland. lee broke that news in a video message this morning. it follows weeks of speculation and a public push from other city and community leaders. 78 year old, no stranger to the town, she's been on oakland ballots for three decades, having first been elected to the state legislature in 1990. and she's represented oakland for close to 30 years in the house. this is really important in terms of trying to bring people together, because so many people i've talked to, labor, business, community activists, i've talked to members of the clergy, and the same issues keep coming up. and so i said, well, let's do this. and i'm very excited. now, lee is facing more than a dozen other potential candidates. oakland voters will ultimately decide who their next mayor will be in a special election on april 15th. we're back i
