nbc bay area's terry mcsweeney joins us from levi's stadium with the details. terry, how'd this happen? >> reporter: county agencies are going to have to million to the 49ers and they're going to have to forget about $6 million per year that they were anticipating, all because levi's stadium, it has been determined, is not as valuable to the 49ers as previously thought. the santa clara county assessment appeals board has cut levi's stadium assessed value to the 49ers in half. so the team is being assessed really only during football season though it makes some money from concerts and controls the events year-round. >> if i controlled all of the events that happened in the stadium outside football, i have a value. okay? and that's what i think the assessment appeals board ignored. >> reporter: $36 million has to be refunded to the team from the county this year. 13 million of that from schools, which also lose out on $2.5 million annually going forward. the district says no programs will be cut. >> fortunately, santa clara unified has very prudent fiscal policie

reporting live, sam brock, nbc bay area news. >> sam, thank you. >>> on the other side of the bay, a person was badly burned while trying to keep warm. nbc bay area's pete suratos in contra costa county. good morning, pete. >> reporter: yeah, good morning to you, scott. we're live in concord, where it was a little colder earlier, now about in the mid 40s or so. but there was an incident in another part of contra costa county in antioch, where a van caught on fire and it may have been a result of those cold temperatures we were seeing in that area. we want to show our viewers some of that video of the van that caught on fire. according to contra costa fire, happened roughly around 3:30 a.m. two homeless people inside of this van in that old kmart parking lot just off of 18th street. fire officials say this may have been caused by candles inside of that van for both lighting and keeping them warm. now, the male occupant in this van was luckily half asleep or awake and got his female companion out of the van. she was sent to a hospital in critical condition. but fire officials say it cou

bay area but one person has died. downed trees killed a homeless man in oakland. it also led to delays on bart. nbc bay area's sergio quintana has been crisscrossing the east bay and joins usils. sergio. >> reporter: raj, that rain has been coming in waves, but the devastation here in the east bay has been pretty constant. the chp still investigating that situation that killed a man as he was trying to seek shelter from the storm. the most powerful storm of 2019 has turned deadly. a man in his 40s was killed on an embankment in oakland. >> a branch from the tree due to the rainy stormy condition had fallen and struck an individual below. a medic from the oaklandir departmehe scene. >> reporter: chp says the man was homeless and was sleeping near the freeway when it happened. tanya dino watched as the chp and the alameda county coroner's office investigated the accident. >> the weather's really, really bad, and it's just unfortunate that people had to lose their life tonight with this weather. >> reporter: no one else was in this video of a big rig on its side on the richmond-san rafael bridge. the

nbc bay area's marianne favro is live at a pet store in los gatos. is the hope this will lead to more pet adoptions? >> more pet adoptions, and hopefully diminish the number of puppy mills rather here in california. now here at petco, the company is already complying with this new law. they don't sell any rabbits, puppies or kittens, but what they do do is they do work with a foster agency to adopt out rescue pets here at the store. california will become the first state where pet stores can only sell dogs, cats, and rabbits if they come from rescue groups or shelters. as a result, this pet store in campbell is no longer selling rabbits bred by the owner. pet people in los gatos does not sell pets and will not be impacted, but teresa gleason says she supports the law. >> i believe that is the intent of the law, to kind of put the puppy mills out of business. they don't treat their dogs right. >> reporter: she says people who want a specific type of dog are better off searching for a reputable breeder. >> this is jack. he is nine months old. >> report
