you. >> reporter: tonight the battle against covid, and its war on all families miguel almaguer, nbc news, los angeles. >>> now to a story on a lot of minds tonight, the battle over reopening schools in the growing clashes between teachers unions and state leaders. plus a georgia school district facing a new challenge, bringing kids back. here's stephanie gosk. >> reporter: the first day of school in cherokee county, georgia, high schoolers were all smiles, and no masks on monday. the district recommends students wear them but doesn't require it that afternoon a second grader in the county developed covid symptoms and later tested positive, according to the school system, which a day later announced that a first grader, an eighth grader and a kindergarten teacher also had the virus in just the first week have been quarantined. the district says it has done contact tracing and will keep the schools open while also offering a remote learning option. this parent is keeping her son at home. >> i hope somebody is learning from this i hope at least better practices are going to be put in place

so let's bring in nbc news correspondent anne thompson. i'm confused by this. in new york is well less than 1%. it's a place that's really gotten the virus under control. why is the teachers union saying it's not safe to reopen? >> because from their point of view, katy, this is about more than the positivity rate. the union has issued a three-page list of safety demands that they say they want enacted before anyone steps foot into a classroom on september 10th. that list includes well stocked cleaning supplies, ppe and proper ventilation for every school. a clear plan of action and a covid response team for each school. and testing for every single student and adult before they enter a school building. that's some 750,000 people, a huge number. now, like many officials, new york's mayor bill de blasio said he will not open schools if it is not safe, but here and elsewhere around the country, there are a lot of parents, students, and teachers who just don't buy it. >> anne, what is the city saying about the ability to make sure that the schools are safe to meet

an nbc news analysis has found that new cases have surged there 175% in the last two weeks, all while more and more are trying to get tested. joining me now from outside an urgent care facility in hoboken, new jersey is nbc news correspondent ron allen. ron, how are facilities in new jersey like the one you're at today handling all these folks who want to get tested? >> reporter: they see it as great news. they see it as the way to solve this problem. you can see behind me there's now a sign that says no appointment necessary. so they're encouraging people to come in. and the numbers have been going up and they've. fighting infections. and this community has a fairly robust contact tracing program. they're able to identify a dozen new cases recently and ensure they were related to travel, people who had left this community and gone out to other places. so they're trying to control that way by testing. we expect to hear more from governor murphy right about now as his daily briefing on the status of things. the last few days have looked encouraging, we understand. the numbers spiked at
