to me, given the amount of money, federal money the ncaa gets. let me just ask you this. a total of five teams, five women's volleyball teams, wyoming, southern utah, utah state, nevada, and boise state, all forfeited seven games in their conference play, ncaa conference play this past year, women's teams, because a biological male, under your rules, was playing on a rival's team. how is that not denying them the benefits of the sport? why is this fair to women? >> and when that issue went to federal court, the judge sided with participation. >> no, the ncaa did not go to court. that is not true. >> a federal judge made the decision with respect to the issue you just raised -- >> your rules have not been tried in federal court, and your rules explicitly permit biological males in women's sports. i am asking you why is that fair to the women? all of these women on these teams had to forfeit games and a chance to compete in the championship because of your rules. i want to know, why is that protective of women? that's my question? >> so far, the fe

well, i would say i'm a member of the ncaa. the ncaa is made up of all of the membership. and we've been slightly dysfunctional as well. that's true. that's led to us being at this particular juncture here. but it's going to take a collaborative effort from us and the legislature to be able to get a handle on all of this. one of the major issues that we have been, you know, looking at is this sense of employment. so the house element has come down. they're going to have to maneuver their way through the house settlement, but we're still going to have this employment issue that we're going to have to deal with. there's been some initial rb hearings and it seems as if, you know, is going to side with labor. i self-admitted was not a great basketball player. i wanted to play collegiate basketball. i went to prairie view a&m university to play basketball. when i got to private a&m university, they immediately canceled their athletics program because of funding, right? we brought it back as a non scholarship sport. why do we bring it back? we lost half of our students, which me

there's no doubt this has impacted the ncaa and student athletes. none of the consequences are challenging as what they are experiencing. each one shows 10% to 15% of division i student-athletes have been harassed. more so in basketball and football than other sports as well. student athletes publicly revealed they get demands for money from unhappy bettors for trivial things that don't in fact the result on the field but it doesn't stop there. many received death threats from bettors and they also receive other in person threats and accusations directed at them when they are leaving or coming onto the field of play. on like professional athletes college students attend classes and live on campus they are accessible to students and fans, some of whom are probably the gamblers yelling at them when they are playing their game. those differences increase the opportunity for threatening coercive behavior across a massive number of participants and create senseless risk. many states gambling regulators lack the authority to ban bettors for harassment. th

the ncaa shifted its stance. division one board of directors clarified that schools could request donors provide funds to checkives as long as those were not directed to a specific sport or athlete. the move prompted alabama and south carolina to repeal nil laws after determining other states will better opportunities to recruit better players. >> freedom for conferences and the people guiding our program to be able to be empowered. right now everything goes to the course. they lose every lawsuit. >> texas passed its legislation in 2023. it stray from ncaa guidance in allowing donations for specific sports. also permits perks and benefits for fans who donate to nil checkives. a clause also made it illegal for the ncaa to punish a school taking full advantage of nil nationwide athletes are pursuing other money making strategies. >> other thing is transfer portal system inter, at a with that a kid jump number of times that's tough for you as a coach. it's tough for a school but sometimes it's tough for the teams. >

the ncaa can do moving forward. but all of that is up in the air. the ncaa hasn't done much to give clarity to the schools. >> what do we know about what the athletes themselves have to give up, so to speak, to the boosters and the benefactors when they take this money? >> they -- they don't have to give up much except the knowledge of where they are in the market they don't know -- a lot of these contracts don't allow them to discuss how much they're making they don't know what their colleagues are making. depending on if you are a men's athlete in a high profile sport like basketball or football or athlete in a lower profile sport or woman's sport they have to give up the time to create content that will draw these corporations for them to make money while if you were a men's athlete in a revenue sport, maybe a little bit of time for charity work in exchange for six figure checks. >> i was going to ask you about nonrevenue sports and the fallout. all of the money is being made by men's college football and men's c

so i think the ncaa is thrilled that san jose state university is not going the make the bid to the ncaanow and hope that the attention that this has garnered really nationally stops. and they're kind of out of the boiling pot here. will: i want to to read from the san jose state volleyball coach. he said we do not take away anyone's participation opportunities. sadly, for others who for years have played this seam team -- same team, each forfeiture announcement unleashed appalling messages. you brought up other players on that team, on san jose state, because we have focused a lot on the teams that forfeited to san jose to state. and those girls, it's quite obvious what they sacrificed and gave up. there are players, to your point, on san jose state who tried to say something like brooke sussler, you pointed out, and the coach really came down on them. so they suffered as well throughout this season at the hands of what it seems like, a total failure of leadership at san jose state. >> failure is to to put it lightly because what these so-called leaders did including the coach, the pres

so that will be the argument from the ncaa.eople who are advocates on behalf of transgender persons who are participating in sports in college and in secondary schools, too, that it's discriminating against them, and you are using the female empowerment, part of that lawsuit that was filed by the attorney general said this was on behalf of female empowerment, keeping women's sports for women only. the other argument is you can't discriminate against people because they are transgender. that is discriminating against them on the basis of their sex. >> catherine, i have another question, different topic. quickly, when might this happen, if it does happen, 2025, 2026? >> it's going to take -- it's going to have to go -- first it will be appealed if there is a -- either side. so this will happen during the year of 2025, a full year. >> great. while we have got you, also staying in this legal bucket here, the president-elect also saying to move on to another topic he would like to carry out the largest deportation program in america

[applause] to speak specifically both at the state and federal level, what we are seeing across the nation, 25 states have enacted some sort of fairness in women's sports bill, protecting sports on the basis of sex. we have seen eight states modify and define words woman and law. i cannot believe we have to do that. unfortunately not only is it necessary i would argue it is urgent we do so. we have seen legislation introduced at the federal level, the protection of women and girls in sports act. it fell along party lines. 219 republicans voted in favor of protecting women and all 203 mothers and fathers of their own young daughters, all 203 democrats voted in opposition of protecting women and girls in sports. yeah. beyond disappointing, especially coming from the crowd that claims to protect women's rights. we know what they mea
