neal. mr. neal: actually, about 3/4 of federal employees are paid through the general schedule. about a quarter are paid in other pay systems. and so as president cox said, there are locality allowances, there are retention allowances, there are things you can do with the general schedule. many of them take a long time getting special salary rates approved for a particular location. can take o.p.m. a year or two or three years. so it's a very cumbersome pay process. during every presidential transition for the last dozen years or so, the partnership for public service, the national academy of public administration, senior executives association, other good government organizations have recommended modernizing civil service pay. t.s.o. pay is a significant problem. there are other federal employees whose pay is suffering as well because the general schedule is not adequate to meet the needs. so -- mr. correa: i would say, mr. neal, given what these employees do, keeping us safe, we can talk about the border, the refugee crisis is a major issue, no doubt. we can debate how to addr

the ways and means committee chairman, richard neal, is demanding six years of financial records with subpoenas to the treasury secretary and the irs commissioner who had spurned an earlier request. and faced with what they call unprecedented stonewalling by the trump administration, house democrats are considering wrapping together multiple contempt citations into a single package for a floor vote. the judiciary committee has already voted to hold the attorney general, william barr, in contempt. chairman jerry nadler says a deal is still possible in barr's case, but he's setting an ultimatum for testimony by the former white house counsel, don mcgahn, threatening possible contempt action. nadler says negotiations are still under way for special counsel robert mueller to testify. house speak i'll speak to jerry connolly and our correspondents and analysts will have coverage of the day's top stories. let's start with manu raju up on capitol hill. this is a significant escalation that we're seeing right now. will the subpoenas get the democrats the president's tax returns? >> reporter:

neal, how did you interpret that? >> not at all. with all due respect. >> okay. >> what mueller says is i can't indict a sitting president. that's page one. and page two is, if -- even if i had all the goods on him, i can't indict him, and if i could clear him, i would. the reason the conclusion reads the way it does from mueller is because that's all he could do, is just lay out the evidence. he couldn't reach a conclusion. i mean, if you had to read between the lines, it sure seems like he's -- >> bill barr claimed he could have. did bill barr just mislead the united states senate? >> i do think so. >> republican senator after republican senator yesterday claiming, hey, his job was to indict or not indict. he didn't indict. >> that's ridiculous. i mean, barr's -- barr himself presides over the justice department, which has these two opinions which say a sitting president can't be indicted. and then barr goes before the senate yesterday and says, well, prosecutors always in ordinary cases issue binary choices. to indict or not indi

so neal announced they were taking the measure of issuing subpoenas. but as we've seen with the last few subpoenas that house oversight has requested of the white house, you know, these haven't necessarily panned out, and again, you know, there is an unprecedented amount of, you know, unwillingness to cooperate with congressional oversight here that is going to put a test to the courts and you know, cause a very pro tracted legal battle to play out. >> we heard mnuchin -- when mnuchin rejected the request last monday, he said that it lacked a quote, legitimate legislative purpose. does that hold any water, jackie? >> well, you know, that actually is -- you know, i don't know if it necessarily holds water, but i do think a problem that richard neal is facing here is because there are so many protracted legal fights going on all at the same time right now from house democrats there isn't a completely salient message, and what you've heard from are the white house on a consistent basis is, you know, let's move on. a lot of these investigations don't perta

i have to say that congressman neal, chairman neal is correct based on the law.s clearly -- it really -- there's no discretion there, it's pretty mandatory. i will say this i do think that neal is taking the wrong tack in the way he's trying to obtain the returns. i think it would be better if he took the rationale that he needed to take a look at the returns, congress needs to take a look at the returns to see if there's conflicts of interest. we learned this last week from the "new york times" that even if donald trump was a private citizen they might want to take a look at those tax returns to see if he's paying his taxes. but in any event i'm not sure they're using the right rationale. >> quick last word from the supreme court justice john paul stephens now telling "the wall street journal" i think -- i think there are things we should be concerned about. there's no doubt about that. the president is exercising powers that not only belong to him -- that don't really belong to him, excuse me. i mean, he has to comply with the subpoenas and things like that. so

now, richard neal has a few options. ahead and say that the treasury department is not fulfilling their legal obligation for this information. or he could file a subpoena on top of that and then go to court that way. so those are a couple of the options. we have not heard yet from richard neal. this request being denied just moments ago. wolf? >> and it's not a surprise, lauren. we never anticipated that steve mnuchin, the treasury secretary, would go ahead and do this. so i assume the democrats, richard neal, and the house ways and means committee and other democratic leaders, including the speaker, they have a game plan in mind to take immediate action. >> well, absolutely, wolf. from the very beginning, richard neal has been clear that he's been building and preparing for a court case. he never expected this to come easily. back when i interviewed him in november, he said that this was all about going slowly, being careful, being deliberate, making sure that all the ducks were in line for when the inevitable court cas

. >> we are joined now by neal katyal, justice department veteran, former acting solicitor general and msnbc contributor. he wrote the justice department rules governing the special counsel. neal, very eager to get your reaction to what we've learned about the communication now between robert mueller and attorney general barr. >> thank you, lawrence. i guess my reaction is dios mio. like, i can't even imagine where to start. i mean, it's not just the fact that there are disagreements between barr and mueller. we kind of knew that. it's not just the gravity of the disagreements and it's not even just the fact that mueller decided to go to paper to create a historical record. to me the most significant thing, and you just heard it at the end of your segment, is this line from the mueller letter which "the washington post" is reporting. "the barr letter threatens to undermine a central purpose for which the department appointed the special counsel to assure full public confidence in the outcome of the investigations." that's a quote from mueller's letter to barr that "the washington post"

that is the exact mirror of the federal law that chairman neal has been using to get his tax returns. so new york state tax returns mirror federal tax returns. they contain much of the same information, so chairman neal may now be just weeks away from obtaining donald trump's new york state tax returns, which will be almost as revealing as his federal tax returns. in the meantime, the "new york times" has taken a giant step closer to donald trump's tax returns with their blockbuster reporting last night on 10 years of irs transcripts of donald trump's tax information showing that donald trump lost over a billion dollars in those 10 years and did not pay taxes in eight of those years. the "times" article quotes the former director of research, analysis and statistics of the irs on the accuracy of irs transcripts, he will join us in just a moment. house speaker nancy pelosi commented on the "new york times" story today. >> that does tell us, though, that it would be useful to see his tax returns as the law says. the administration shall give -- shall. it doesn't say must, should, could,

i think there are two choices chairman neal and congress could use.oth will be protracted and delay from the important other work that congress should be doing so one option is to subpoena the tax returns and the other option is to sue under the statute itself in federal court. either way, this will have the house's lawyers will have to bring the salutes and the president is throwing plenty of other work at the house counsel office suing for example to overturn the affordable care act. this is another stall tactic. this president doesn't want to provide anything. he doesn't want to provide the underlying documents that mr. mueller used. he doesn't want to provide the tax returns. he doesn't want to provide this and that. this is one constitutional crisis after another. all of which is avoidable if the president will simply understand that in the united states of america, nobody is above the law. >> and we are about 18 months away of the tax returns being handed over if there is a new president after inauguration day because there would be a new irs co

well, now the chairman in question here is richard neal. he's a veteran massachusetts congressman. incidentally he's my congressman. even though he's my congressman, i would have a hard time picking him out of a line-up at a distance. he's just a low profile dude. he doesn't go on tv a lot. he doesn't make a big stake about this fight he's waging now. but he's been plugging away and pursuing this in his own one foot in front of the other careful way. and whether or not you like that about him statistically -- i mean stylistically, whether or not you are in tune with the way he's been pursuing this, richard neal having a different approach than all of the other members of congress and all the other combatants who are fighting all these other fights with the white house richard neal having a different approach is to be expected given that his fight is the effort to get the president's tax returns on a totally different basis than all the other fights in washington are taking place on right now. i mean, he's got this law he's trying to have enforced. he's simply telling the treasury d

house ways and means committee chairman richard neal has just issued speakubpoenas.ox who has been covering this battle for the president's taxes. this is quite the escalation, lauren. >> reporter: that's right. richard neal has been saying all day he would have a decision by the end of the afternoon. here it is. he is saying essentially in two different subpoenas, one to the irs commissioner, charles reddig, the other to steve mnuchin, i demand that you hand over the president's tax returns by may 17th. so setting essentially a new deadline for that tax information to be turned over. as you might remember on monday the treasury department said they would not turn over the president's tax returns, so the subpoena is an escalation, but this is going where we thought it was going this entire time, which is right to court. >> how significant is this? >> reporter: well, there were a couple of options that chairman richard neal had at his disposal. one of them was going directly to court, and that is because the irs statute that he was using to get the president's tax ret

we were expecting congressman richard neal, the chairman of the ways and means, we were expecting him to announce some sort of next steps today in terms of how he was going to try to force treasury and the irs to comply with this legal request. we weren't, though, necessarily expecting a subpoena. at least i wasn't necessarily expecting a subpoena. my expectation and i think some other peoples expectation was that chairman neal might skip the subpoena and head straight to federal court. "the new york times" spoke to a staffer on the ways and means committee. he said house lawyers ultimately decided not to do that. they decided going straight to the courts might carry serious risk. but the president and his administration refusing to comply with any request for testimony or documents, whether or not it comes with a fancy subpoena orb it's unclear tonight if they've avoided that additional risk by issuing these subpoenas today rather than going straight to court, whether it puts their demand for these tax returns on stronger or weaker legal footing. we don't know what the practical impl

lauren, you just got some new information there from chairman neal.ell us what you've learn. >> well, that's right. richard neal all day saying he'll make a final decision by the end of the day, depending on what he wants to do when it comes to the next steps in that fight for the president's tax returns. a couple of minutes ago richard neal, i asked him, you know, has he consulted with his members and told them what he plans to do? here's what he said. >> they will all know this afternoon. i've given hints to them but i've been careful that they will know i would think in a couple of hours. >> back in april the chairman made that initial request. now he's got a few options ahead of him. he could either subpoena for this information and then go to courts, or he could move to directly go to court. those are the options ahead of him. he says by the end of the day we will know what the next steps, are but i just want to say that richard neill is a very pragmatic member. this is not the end all be all of what members on the committee wants to do. he wants

chairman neal explained why he did not go to the courts first. he wrote, quote, while i do not take the step lightly, i believe this action gave us the best opportunity to succeed and obtain the requested material. earlier a top member of the ways and means committee laid out was on the table if the ways and means committee defies their season. >> we should consider the power of inherent contempt, an old doctrine that allows the congress itself to issue a summons, arrest warrant to an official and demand they appear at a congressional hearing, be subject to fines, to jail time. i think we ought to explore contracting with aerial correctional institutions, provide additional support to the sergeant in arms so the white house knows we're serious. >> and the president defending his now $200 billion in tariffs to chinese goods. this morning the president again argued the u.s. could make or, quote, produce products in the good ole u.s.a. it's very simple. as trade talks between the u.s. and china stalled yesterday, the president continued to make this

chairman neal has the authority to get these tax returns. the authority is highest when there is potential misconduct or conflicts of interest, which may be the case here. my belief is this is all going to come down to justice roberts. justice roberts' clerked for judge friendly one of the great jurists of our time and should believe about the credibility and court of the constitutional system and hope will follow the law, expedite this and rule for cong. otherwise, he risks undermining the credibility of the courts. >> do you agree with chairman neal's approach? he's gone for a subpoena instead of going straight to court? >> i do. i would have done it faster. i think we should have gotten this request out probably months ago. because i anticipated along with other progressive there's would be stonewalling. now we should have the subpoena and i do think we'll be vindicated in court, and i think that he's doing things deliberately to make sure that he's dotting the is and ts for when the case does go to court. >> your response to that questio

and now, neal is laying out what he is going to do next.'s lauren fox on capitol hill. great to see you. you just spoke with the chairman. safe to assume he is not going to be getting what he wants. so what is he going to do then? >> that's exactly right. he's not holding his breath he's going to get the president tfs tax returns, six years of personal returns and six years of business returns, today from that subpoena. so instead, he has a couple of options ahead of him. he could move forward with contempt, although he says that's not something he plans to do, or he can move directly to court. here's what he told me just a few minutes ago. >> after the election, i indicated that i thought this would end up in a long court case. i have not seen much in the last few weeks that would dissuade me of that position. >> do you view contempt as a potential option? >> i don't see what good it would do at this particular time. i think that if both sides have made up their minds, better to move it over to the next branch of government, the judiciary.

could be legal action taken moving forward and those are the options before the committee, before nealt i think they are going to be cautious and take their time here and not rush into anything because they don't want to take a political risk, they don't want to overstep. >> the trump administration also missed the house judiciary committee's deadline for the unredacted mueller report. but the justice department extend said an offer to negotiate the continued effects and negotiate on wednesday. do you think that's simply a stall tactic? >> well, it's hard to say. it does look like the justice department wants to pull back on what has been a dramatic escalation between democrats and the trump administration. and what he effectively said to jerry nadler was come by on wednesday, and this was of course missing the deadline nadler had set forth 9:00 a.m. today to share an unredacted mueller report with congress. the real question is whether there's going to be any grand jury information. nadler does believe members of congress are entitled to grand jury information, and they're working to

those tax returns are being illegally withheld from chairman neal by treasury secretary steven mnuchin, but chairman neal will eventually succeed in obtaining those tax returns because the law is entirely on his side. in the meantime, though, tonight's "new york times" reporting is the most detailed picture yet of ten years of donald trump's financial life from 1985 to 1994 and it shows donald trump declaring losses of 1 billion over that ten-year period while paying relatively small amounts of federal income taxes in 2 of the 10 years. in eight of those years, donald trump paid no taxes at all. one year shows a mysterious surge in interest income for donald trump of $52.9 million with no accompanying evidence of any assets that could produce that much interest. but donald trump paid no taxes that year because his business losses were higher than that interest income. in the middle of the period studied by "the new york times," donald trump testified to congress about just how hard it was out there for a businessman like him. >> the real estate business, we're in an absolute depression
