solicitor general neal katyal.i, is basically in a war against voting in a war against democracy and what the justice department did today is absolutely right. what the justice department is did is they said, look. redistricting, the process of drawing voting districts, occurs every ten years. there is an obvious problem with what texas is trying to do here. they've dropped the number of hispanic districts from 33 to 30 even though in the last decade half of the 4 million residents that texas gained were actually hispanic. so hispanic majority districts you'd expect there to be at least 33 or 33 plus and less games being played. i think it has two really important implications. one is that for most of our lives this law, this texas redistricting plan, couldn't have just gone into effect. because there was a voting rights act since 1965, which said if such a law is to take effect it first has to be precleared, given a thumbs up by either a court or by the justice department. because the supreme court recently struck

neal, what is the likelihood of success in this suit? >> if there were a negative percentage i would offer that but it would be zero percent if there is not a negative percentage. there is a foundational doctrine in our law, a supreme court case that says basically you can't just file a lawsuit because you're worried that an investigation might come out against you or even frief someone of their rights. the remedy the supreme court says is to raise that in the context in the investigation not to run into another federal court and try and stop it. and so trump is complaining here like every other target of an investigation, civil or criminal, and our legal system undoubtedly says you can't do that. so at this point i got to wonder about donald trump's psychology. this is a guy who supposedly hates losing but he keeps coming back to the table after every failed bluff totally convinced he'll win the next one. it is nuts to me. i'm sure his legal team is crying all the way to the bank as they charge him legal fees for all of these silly fili

. >> so the big question, neal katyal, is will these documents be handed over in two weeks? which they could be, they could be handed over in two weeks. if the supreme court refuses to hear the case. and in a pre trumpian supreme court, i would be sitting here absolutely certain that the supreme court would simply not grant assertion, i would simply throw it away. >> so the court of appeal, gave trump's lawyers 14 days. i'm sure that they will because delay is the name of the game. and this delays them by the so few weeks. and, lawrence, a president would get the court to hear such a case. it's a rare thing to have a former president ask of this. so in general court they would ask this. but i don't think the supreme court is going to hear this case. i think they have to be frustrated, politics all aside, by donald trump's claims, time and again, all sorts of bogus claims particularly over the election. and things like that. and i think the most important point here is the way that trump lost in the court of appeal will -- not just for one reason but for five different reason
