leading off, neal katyal, msnbc legal contributor. thanks for joining us tonight. as soon as i read what the judge said about william barr, i was eager to talk to you about this. disingenuous is not a word i find myself using because i'm not a federal judge but carefully used in situations like this. what do you make about what the judge is saying here about william barr? >> it's hugely significant, lawrence. yesterday in my city of washington, d.c., we really had a tale of two attorneys general. one, merrick garland testifying in congress, carefully, methodically, sober, balanced, and then second we had this description of bill barr from judge amy jackson who is regarded as one of our nation's top jurists, and what a contrast. attorney general is supposed to be the attorney general of the united states people, not the attorney for the president. and what judge jackson's opinion, you're isolating that key word "disingenuous" and that's right word, she's saying you were a liar, you were doing donald trump's bidding and not being attorney general. that's a word judge

joining us neal katyal, former solicitor general and msnbc contributor. have to say this is one i did not see coming as a reason for keeping awaiting defendants in jail, but there is this outside force ready to meet them in effect outside of jail in the voice of donald trump to provoke them to violence. >> exactly, lawrence. i'm pretty sure i have never seen a federal judge do quite this. i think she did so, judge jackson is an extremely, extremely well-regarded federal judge, because of an unprecedented threat to democracy and lies. as you were saying a moment ago, she called it a, quote, steady drumbeat of conspiracies. i think that may be the first time anyone has ever accused the republicans of having rhythm, but, you know, the context here is she is trying to decide whether or not to release these defendants, these january 6th defendants from jail, and one of these people, mr. meredith as you were saying, was a guy who text he wanted to shoot nancy pelosi, who tried to bring ammunition and guns to washington in january. so in other words i think many

joining me now, neal katyal, former acting solicitor general, msnbc legal analyst, and esteemed guestal, thank you for being here. you were a special prosecutor in the george floyd case so i know you're very limited in what you can specifically say. but can you tell us what these three are facing and what action you're taking? >> yes. so alex, thanks for having me on. as i say, i'm extremely limited in what i can say. i'm just going to talk about the public record and just say, i argued in court on thursday that the three other cops should be charged with third degree murder, not just manslaughter. that's a request we made back to the court in february, in the trial court, before the chauvin trial. the trial court rejected it both with respect to officer chauvin as well as the other three defendants. we then brought that up to the court of appeals with respect to chauvin and got the third degree murder charge reinstated. and now the question before the court of appeals is whether or not these other three cops can be charged with third degree murder as well. that's what we argued on th
