. >> leading off our discussion tonight is neal katyal, former acting solicitor general and msnbc contributor. neal, i want to begin with that last point that the chief made about his hypothetical and what if the amount of money were higher, trying to show what the chilling effect is on behavior because of the threat of lawsuits. >> exactly. so, you know, as an advocate, the last thing you want to do is get what the chief justice said in that question, which is, hey, this is a hypothetical, please answer it. it was the texas solicitor general's, i believe, first argument. i thought he did well with what he had to work with, which was not very much. lawrence, i think the conventional wisdom among chief court analysts are you can't predict much from the element. they're asking tough questions from both sides. if i think back to my 45 oral arguments at the court, you can often predict where the court is going to come out, and i think it's likely that texas did lose the argument today, both because the audaciousness of the law and they already lost in texas because two months ago a procedural cas

joining our conversation, neal katyal, former acting u.s. solicitor general. tell me what this lawsuit is about, and what doj hopes to achieve. >> yeah, so, this is a really sophisticated lawsuit, nicole. it kind of represents the justice department at its best when using its career lawyers to really go into detail about what this texas law does and then go into detail about the united states code. so, it challenges things like, in texas, the new law prohibits, you know, if someone has minor clerical errors, for example, in their vote, it basically throws that vote out, and what the justice department says is, well, there's actually this fairly obscure law from 1964, section 10101 which prohibits that kind of thing and ordinarily the justice department uses broad statutes like section 2 of the voting rights act to bring these things and that's at play here but what they've done is really delve into the details of the texas law and said, on the ground, here's how it's going to play out. another example, there's this other provision in the voting rights act, sect
