a draft opinion, a pre-published opinion, is how the justices got there, and i think -- i think neal katyal on something. he said these justices know exactly what they are do, and i think neal is absolutely right. i think justice amy coney barrett, when she wrote here and i'm going to read, that the court had miscalculated in a grant to take this case before the appellate court has weighed in, i think she reads the same newspapers that you and i read. i think she saw and the court saw all of the electoral results that have happened across this country, an every time now, ana, every time when abortion access is on the ballot, including in deep red states like kansas, it wins, and i think the court was deliberately trying to get itself outside of this box that it created for itself. it doesn't smell right how we got here. >> do you agree with that? >> i do. there's something odd about the fact that in order to hear this case there had to be a vote of at least four justices and now at least according to the document that was posted yesterday, there are six justices who are saying the case was,

joining me now is neal katyal, former acting solicitor general and msnbc legal analyst. eal, please tell us how unusual was it for this hearing to take place, and what new could have possibly been learned on today? >> well, joy, i really like the way you started by saying if these were normal times. because this hearing today and these hearings before judge cannon are anything but normal. she's been entertaining days of arguments about whether the special counsel is unconstitutional. which is pretty much a laughable argument. you know, i had the privilege of drafting the special counsel regulations back in 1999, a long time ago. i can tell you that we went and presented them to the house and senate leadership, including republicans, including their top republican lawyers for the house and senate. everyone thought they were constitutional. nobody thought there was any possible problem. and indeed, as you said, they have been repeatedly, this question has been repeatedly litigated, repeatedly lost. this is an enormous waste of time. and these are specious arguments but i th

neal katyal is with us, former acting attorney general who has argued more than 50 cases before the supreme court. he is a professor at georgetown law. they are both, we are lucky to say, msnbc legal analysts. andrew i want to start with you because of your experience in the justice department and the fbi and to take this oversight hearing seriously today, the imaginary world in which this can be a serious hearing. there are so many serious issues of oversight that should be a concern to the house of representatives today, at this point. where the department is. what is your reaction to the republican approach we sought to this hearing, including members who actually said out loud repeatedly they want to abolish the fbi? >> so, i want to try to differentiate sort of republicans now versus what i would say is democratic and republican traditional support for law enforcement and the fbi specifically. prior to trump, the fbi was viewed as a political and it is and was a political to its core. it's sole mission is to protect the american public and whether it is street crime, bank robbers, cybe

joining us is josh gerstein outside the supreme court and neal katyal. 50 cases before the supreme court. josh, stand by. i want to get to idaho in just a moment. neal, are you expecting to hear a decision on immunity today? and if not, why would they wait until the very end on that one? any tea leaves to read here? >> so no tea leaves really. it could come down today or tomorrow, or there may even be a day added next week. my gut is it will come down tomorrow and it will be the last day of the term. why? because some of the most controversial cases, particularly the ones argued late in the supreme court term, as this one was, do often go to the very last day. the hard part to understand here is this is not a difficult case. this is a case that many different judges have looked at, including quite conservative judges. they've looked at donald trump's claims, and they think the idea that a president can do whatever he wants and the criminal laws have nothing to do is ridiculous. there will be some nuance and so on, and that should take some time for the co
