the medical examiner who conducted nealy's autopsy testified she had no doubt nealy died from the compressionf his neck. let's get right to cnn's gloria pazmino outside the courthouse. what's expected today? gloria yeah. >> john that piece of testimony from the medical examiner is critical because the defense in daniel penny has tried to argue that jordan nealy did not die of the chokehold, that he died from all these other set of factors that contributed to his death. so the medical examiner's testimony is critical for the prosecution to prove that it was, in fact, this choke hold. and the amount of pressure that daniel penny applied to jordan nealy's neck that killed him. now, the medical examiner remains on the stand this morning. she will be crossed by the defense team. and then we are expecting the state to rest its case then it will be up to the witnesses. and we are expecting the defense team for daniel penny to begin calling character witnesses. these are going to be witnesses who are going to speak about daniel penny that what daniel penny was trying to do was protect people that wer

gillian: the manslaughter trial underway for daniel penny, the marine veteran who placed jordan nealycotton is in manhattan with the latest. what can you tell us? >> hi, gillian, the first day of the trial off to a dramatic start. responding officers took to the witness stand as never before seen body camera video was played for jurors. >> what happened? >> came on, came on (bleep). >> we just came in and he was what-- >> (bleep) threatening. >> prosecutors pointed to the statements on body camera as proof that nealy's humanity was disregarded, but during cross examination, the defense suggested to jurors showed that penny had nothing to hide and was cooperative. the first round of friday's opening statements with prosecutors telling jurors that jordan was homeless and on synthetic drugs and homeless when he got on the train and that indeed he had scared subway riders. they said despite those things, penny was reckless and kept nealy in a chokehold and no longer a threat. and said with his military training he should have known better. penny's statements said their client heard him sa

, including nealy's overall health and drug use, played a role.o is in new york following this. tell us what else we heard from the defense this week. >> well, jim that last part you mentioned is critical because what the defense was trying to do was counter much of what the prosecution said for several days that nealy had died from the chokehold that daniel penny put him in. >> that's what the medicals, the medical examiners testified to. >> so they brought in their own medical expert to counter that and to say instead that nealy died from a complicating factor including sickle cell disease. >> the fact that he was on k2 at the time and that he suffered from mental illness. now, the question here is what will the jury think? >> they are going to be likely starting deliberations following the week after the thanksgiving holiday. one critical thing that we were waiting for in this was whether or not penny was going to take the stand. he decided not to do that in this case, but we did have a chance to hear directly from penny during this trial, and

criminally negligent homicide in the death of jordan neely last year penny told investigators he put nealy in a chokehold just after the homeless man started shouting at train passengers how long had he been on there before you intervened? >> i mean, he got on he whipped his jacket off. that's i mean, usually i don't crackheads, you know what i mean? i just kind of like to do the thing. but then he started threatening people. once he starts doing that, that's when you try to subdue him. yes i'm. i'm not. i wasn't trying to like injure him. right. i'm just trying to keep him from hurting anybody else. he's threatening people. that's what you. that's what we learned in the marine corps. that's what you guys learn is in the cop. that's police officers. >> well, prosecutors say they don't believe penny intentionally tried to kill nealy, but argue he went, quote, way too far after holding neely's neck for about six minutes. a witness for the defense argued penny's chokehold wasn't fatal, but said a combination of factors led to neely's death. now a major breakthrough of the cop 29 summit in aze

the medical examiner said that the chokehold without a doubt according to her findings, had killed nealy elliot. >> we are still learning and waiting to see if they're going to actually have him testify what does that tell you? would you have him testify? >> i would not, and big picture, laura, of course, a defendant has a right not to testify under the constitution. you have the right to remain silent. literally that's what the cop shows. all say. most people think that if. if your liberty were on the line you would choose to testify to clear your name and defend yourself. it's very risky. and most defendants don't testify for a number of reasons. one, everything. any statement you've made or given can be thrown back at you by the prosecution. you can be impeached, you can be undermined, and also confronted with some of the strengths of the prosecution's case. and you're giving them the opportunity to guide the questioning of you. it would be very risky this is a very emotional and sensitive case, and i would just think it's probably best to to leave it to the experts that they're calli
