neffenger, admiral neffenger, who cleaned up a mess called deepwater horizon. where the coast guard was buying ships that didn't float, radar systems that were supposed to have surveillance of 360 degrees with 180 degrees, radios that when they got wet they didn't work. he cleaned up the mess. and saved this country and the coast guard probably hundreds of millions of dollars and sir, no matter what happens in this hearing, i if ythank you. i really do. last month our committee heard testimony from three transportation security administration employees. they raised troubling allegations about personnel practices that stretched back several years in some cases. the employees who came forward deserved to have their allegations thoroughly and fairly investigated. and i emphasize that. it's one thing to allege, but we need all the facts so that we can be about the business of not only hearing testimony but bringing about the reform that is necessary. i'm sure you would agree with that, mr. roth. unfortunately, the committee has not yet had the opportunity to fully

i want you to distinguish between what happened post -- pre neffenger, admiral neffenger and post. the chairman spent rightfully so the discussion about the $90,000 bonus. there's probably nobody in this congress who has railed against bonuses going all the way back to aig than i have so i want to make sure that we are putting responsibility where responsibility belongs. i hope you'll do that. nevertheless, during our previous hearing i was struck by how highly those whistle blowers spoke about our witness today, vice admirable neffenger. despite what they en2k50urd, these whistle blowers repeatedly told the committee that administrator neffenger was taking positive steps at tsa. they made clear that he is setting a course for the agency that puts the top priority exactly where it should be, on security. for example, mark livingston, a program manager in the office of chief risk officer testified that administrator neffenger is, quote, a man of integrity. he also said, and i quote, tsa is not going to compromise our mission to expedite passengers though at the expense of our missio

under administrator neffenger, t.s.a.as issued new policies and clarified the membership and role of the executive resources council to curtail the abuse of multiple achievement bonuses for the same activities and ensure directed reassignments are made only to support agency goals. administrator neffenger has also moved to address the airport security lapses identified by the inspector general and by the agency's own testing teams that we examine in this committee's hearing last fall. he has ended the managed inclusion program that committed individuals who had not received background risk assessment to receive expedited screening and he has placed agency focus squarely on resolving all alarms at screening checkpoints. as neffenger testified before this committee last fall, he is and i quote readjusting the measurements of success and focusing on security rather than speed. end of quote. so i am pleased to see that his actions are beginning to show real progress. however, people may not want to hear this, but these action

neffenger needs a team around him that can do that. in this process you're talking about, this tracking, this mechanism, the numbers in the data doesn't lie and it's forever. once you put it into the record and once you track it, it's consistent over time, and that's what we need is consistent, persistent, quality leadership because factual data will make us better. ms. norton: mr. livingston, they gave me something of what you said to staff indicating that these nondisclosure agreements stand in the way. i notice -- and of course, i'd like to know whether you think our bill that says that you can't restrict the employee from disclosing waste, fraud, or abuse to congress, special council or the inspector general, whether that reaches far enough? mr. livingston: i think we overuse the nondisclosure agreements in my agency. i think every legal case we have ends in one, and i think that's an abuse of the power we have. i did write a statement to that. i will look for it very quickly and read it to you. every case from a misconduct or e.e.

what happened when neffenger came in, the new adi add min t addadministrator and now they're spending innocent americans, 99% of whom pose no risk. so it's not a matter of having resources it's how you direct the money and the resources. >> i want to call your attention to this full-page ad, this is the american federation of government employees, the full page ad that they took out in the hill newspaper yesterday urging congress to act, urging congress to pass emergency legislation that would help fund some 6,000 additional screeners. you just heard from the tsa administrator there, mr. neffenger, say the it tsa expects to screen considerably more people this year than they did just a few years ago. how much is congress to blame for these long lines that we've seen? >> well, first of all, the congress and republican congress the last three years each of the last three years gave more money to tsa than the administration requested, each of those years. we also changed the formula so some of the airlines that didn't pay pay and they have more money in fees coming in so they have more m

philipovitch: we've been working with admiral neffenger. we're working in collaboration with the t.s.a. and also promoting many of the actions that t.s.a. is suggesting and already taking and also the actions that are contained in chairman katko's proposed legislation which we're in favor of as well. ms. jackson lee: which means you would be willing to pay for overtime for t.s.o.'s? ms. philipovitch: you know, right now we really want to get more transparency into the staffing model and understand how resources are being deployed. we need to make sure that we have an analytical model that puts resources where they need to be to meet the peak demands of our customers. ms. jackson lee: and i agree with you. and more flexibility with the f.s.d.'s, would that be helpful? ms. philipovitch: in cooperation with the airline partners, yes. ms. jackson lee: would you join with us? because i heard the point being made there needs to be data regarding baggage fees. i think there should be a study on the baggage fees as to whether or not they increase t

administrator peter neffenger to hear his thoughts. we all agreed that the real problem is the shortage of t.s.a. screeners. more people need to get hired and trained so security lines can stay open and people can move through the checkpoints faster. in the meantime, there are immediate steps we need to take in chicago. first we're going to get 58 more t.s.a. screening officers in the next two weeks and 224 by august. that's about a 15% increase in t.s.a. staff. it's a good start. o'hare will also receive five canine teams. that will double the number of canines we have at the airport. two teams were brought in yesterday. the rest will arrive within five days. these bomb-sniffing dogs do important work. they check carry-on baggage. if there is no problem, the passengers can move out of the standard line into the expedited line. these dogs can help us speed up the process by allowing up to 5,000 additional passengers a day to move through the faster security lines. there will also be a shift of 100 t.s.a. staff from part time to full ti

neffenger, last point i just wanted to make. we have a request i want to reiterate the bonus policy. one of the criticisms i believe from the inspector general was there really wasn't a bonus policy in place. so what is it? in 2015, for instance, the senior members that were the tses members who made less than $160,000 were ineligible for a bonus, even if they achieved the highest level of excellence. but if you made more than $160,000. even if your performance evaluation came in lower you could get a bonus. that seems so upside down and wrong. >> i'll get you the policy for the record, mr. chairman, so you can see what we've done. >> mr. roth, do you have any comment on that? >> no, just what was in our investigation, which was that the policy was very sort of loose, but we had a commitment from tsa that they would fix the policy. my understanding is they have. >> okay. it's something we'd like to look at. mr. roth, last question, what's your biggest concerns? >> just the size of the enterprise. 2 million passengers a day, 450
