neil? >> neil: thanks, jennifer.uisiana republican kind enough to join us. this latest news that we've gotten, senator, that china will backstop russia and zooming down the road with weapons has a lot of americans thinking this could go on awhile and some in your own party saying it's got to stop. does that worry you? >> well, here's the way -- yes, it worries me, neil. here's the way i look at it. it's clear that america's relationship with ukraine, with russia, with china, those relationships are now linked. we have decided to defend ukraine. if you decide to be a bear, be a grizzly. we can't blink, especially when you're dealing with hard men like these. i say men intentionally. you don't see too many women in decision making positions in china or in russia. i don't want to see america be the world's policeman. but i don't want to see putin in russia or the ayatollah in iran be the world's policeman either. >> neil: do you worry that some in your party, particularly in the house i should stress, saying a lot of th

neil? >> neil: thanks for that. tom dupree with a legal angle on this and whether the president in the first place had the power to do what he's doing here and pay off $400 billion in student loans. that's what the supreme court is discussing. tom, the former deputy assistant attorney general. genius when it comes to all things legal. is what the president is doing legal? that's kind of the argument for the supreme court that he went a step too far. this is congress's province. what do you say? >> that's right, neil. i got to say based on today's arguments, i feel it's more likely than not the supreme court will say this is illegal. the conservatives were clear in their questions and comments from the bench that they think the biden administration overstepped their bounds, that they didn't have the legal authority to forgive student loans on this massive scale. the other interesting thing, the conservatives were interested in the fairness issue. shannon mentioned this. they say how is it fair to forgive the loan of

neil? >> neil: thanks for that. go to jennifer griffin at the pentagon and how our defense folks are weighing in on this. jennifer? >> neil, the pentagon has asked the public to report and not touch anything from the balloon wreckage that washes ashore. at 2:39 p.m. saturday, a u.s. f-22 fighter jet fired a single missile at the chinese spy balloon, which was six miles off of the coast of south carolina. the high altitude was launched from mainland china. it spent minutes, not hours over u.s. territorial waters off of alaska and crossed in to canada. general glen van hurk explained why he did not order the balloon to be shot down after it entered alaska. >> it was my assessment that this balloon did not present a physical military threat to north america. i could not take immediate action because it was not demonstrating hostile act or hostile intent. >> on tuesday, january 31, the balloon crossed into idaho. the next day president biden gave the order to shoot it down when safe to do so after being briefed by his n

neil: all right. for that community, probably a bit of a surprise as norfolk southern president and ceo alan shaw showing up right now to try to get firsthand knowledge of what's going on and in east palestine. it was a little over two weeks ago that you recall that this train derailment occurred. we're learning more about the derailment itself. this train was almost 1.8 miles long and had 158 cars, 38 cars ultimately had derailed. 11 were containing hazardous material and there were some five toxic chemicals on board, including vinyl chloride. that's the one that has a lot of folks worried right now because even though it's colorless and you almost wouldn't know it or sense it or smell it, some can. and that was the one that would have normally alerted people along a path of the train carrying it that you've got a train coming into town that's carrying it. now, there are different interpretations of the laws and requirements around that. be that as it may, norfolk southern has promised to provide wha

neil? >> neil: thanks, david.cial counsel robert hur was able and is able to formally now get -- hit the ground running on this. he's running to buzz saw problems here. a lot of them could be created by the fbi it sieve. jonathan turley joins us with more. he wrote a fascinating piece on this dilemma in the "new york post." the george washington university professor, fox news contributor. a great piece that put in perspective maybe the difficulty of what hur is up against and what might be a bungled role on the part of the fbi itself. you say at every stage, the fbi has adopted an approach that could complicate any criminal charge. you go on to say it allowed unclear private counsel to tread over all of the scenes, creating a night mare of chain of custody. so in other words, ruining the crime scene, i guess. >> yeah. i mean, the problem that you have, neil, is that there are really two ways to establish intent. first of all, the crime itself is really based on gross mishandling, which is clear here. criminal case

neil? you for that didnt, former new york congressman, former new york gubernatorial candidate. congressman, always great to see you. but i want to tap that expertise because you served in the military honorably and served this country with great distinction. so i want to tap the former lieutenant colonel in you, what you make of the way we are getting briefed on all of this and the confusion around all of this? >> i think the statements coming from both sides of the aisle in congress is reflective of where the american people is right now. they want to hear from the president of the united states directly. they want to know more about what -- neil: oh. we have feed problem here. just going to see if we can fix that here. but one of the things has come up here, the government has been very quick to say these are not ufos or extraterrestrial objects. they know that unequivocally. back to lee zeldin, you you were saying as we technically rudely interrupted you. >> what we're hearing from memb

neil. >> neil: lucas, they knew enough it was unmanned and safe to shoot down. it was a smaller object, the size of a small car versus the chinese balloon last week the size of three buses. three school buses. if you can discern it was unmanned and get close enough to get a good sense of its size, that of a small car, you can certainly discern whether it is a balloon object or something else, couldn't you? >> lucas: you would think. officials are being very careful not to describe this in more detail other than to say an object the size of a small car, unload the 2000-pound payload shot in south carolina on saturday. this was flying in northeastern direction, we don't know where it came from or when it was first detected. we know the f-22 scrambled yesterday and john kirby said last night, so a number of hours, 12 plus hours of observation of the object. president biden gave the order today. it is notable, the u.s. military had to ask president biden for permission, this went up the chain of command, hours after it was detected and the question of origin. russia
