just last month, the new york times breathlessly reported that there were new sexual misconduct allegations that have emerged about brett kavanaugh's time at yale. yet, in the times's initial reporting, and i am only picking on the new york times because lee represents the new york times, in the initial reporting, the paper completely omitted the fact that the women woman who was supposedly the victim doesn't even remember the incident and that she declined to be interviewed on this reporting for this topic. that was a serious lapse of journalistic standards to omit these important facts that would have given readers a more fulsome perspective on the allegations themselves. and pre-sullivan rollback, i suspect they would not have been omitted. should the press be restrained? yikes. what a loaded question, it harkens back to images of reporters in handcuffs. let me be clear, i'm not in favor of imposing criminal liability for defamation. i'm going to write that down. >> (laughs) >> that's off the record. should the press be restrained also raises another important question, restrained by who
